Iranian men to be stoned to death over gay sex
According to the news we have received Ayub and Mosleh, 20 and 21 years old, are in danger of execution by stoning in the city of Piranshahr in the province of Kurdistan. The two young men are currently imprisoned in the city of Orumieh. They have been accused of having and filming homosexual relations. Pictures of President Ahmadinejad were incorporated into the film and loaded onto their mobile telephones. In additions, headshots of Khamenei pasted over a donkey were also found on the mobiles.
This film fell into the hands of the regime’s agents in Piranshahr who immediately ordered the young men’s execution by stoning to instill fear in the people of Iran. The news indicates that they will be stoned this Friday, Jan 21st 2011.
The International Committee Against Stoning calls for immediate action to protest the Islamic Regime’s medieval and brutal sentence against these two young men.
We particularly ask the people of Piranshahr to contact us immediately with further news about this case, and to prepare to prevent this heinous act. We urge the young people of Piranshahr to hasten to the aid of Ayub and Mosleh and declare that they will not permit this tragedy to occur in Piranshar. We must gather and collectively declare that we will not permit the Islamic Regime to murder and stone the youth of Iran in fear mongering acts.
We call on people everywhere to spread the news of the inhuman and medieval act against Ayub and Mosleh and do whatever they can to save them.
After the worldwide campaign against the stoning of Sakineh Mohammadi Ashtiani that drove the Islamic Regime to a weakened position and brought the world out against the murderers of the Islamic Regime and against stoning, the Islamic Regime wants to show that it will not stop stoning and such depraved inhuman tactics. We must stand against stoning in Piranshahr.

"IGLHRC is deeply concerned about the alleged charges facing two men from Piranshahr, Iran, and we are urgently investigating them. We are also concerned that some stories circulating about these men may contain factual inaccuracies and be based on hearsay. Until more is understood, we urge journalists and advocates to act with extreme caution. The death penalty is always wrong, however the specifics of each case matter immensely. Nothing less than the lives of two young men is at stake."

H ουσία είναι ότι εκφράζονται φόβοι ότι η υπερβολική δημοσιότητα μπορεί να θέσει σε κίνδυνο την εύθραυστη επικοινωνία των κρατούμενων με τον έξω κόσμο ("Nothing less than the lives of two young men is at stake")

UPDATE: Iran stoning execution order raises controversy

Some facts involved with the case of two men from Piranshahr, in northwest Iran whose death sentence was reported Tuesday by SDGLN have today been disputed.

A number of sources who are investigating the details of the case, and who are in touch with those at the heart of it within Iran, have today spoken with the Iranian Queer Orqanization (IRQO) and Gay Middle East. In addition the International Gay and Lesbian Human Rights Commission has announced in a message published by the Joe.My.God blog that they are also investigating details of the case.

Questions have been raised regarding the exact nature of the charges on which they have been given the death penalty. As reported in an update yesterday on the original report, those questions surround whether or not a rape occurred and whether this involved another person, a 15 or 17 year old minor.

As noted yesterday, the Iranian government, as reported by Human Rights Watch, maintains in response to international pressure regarding reported executions of homosexuals that they mostly involve “individuals [who] have been charged for forcible sodomy or rape”.

But as noted yesterday by Soheila Vahdati, an independent human rights defender based in San Francisco working with Human Rights Watch, Amnesty International and the Iranian Queer Organisation: “They [the Iranian government] don’t differentiate between rape and homosexual acts."

Whether those charged filmed their acts, what any such film contained and whether that was discovered has today been disputed by some sources.

At this stage it is, however, believed that all sources concur on the fact of a death sentence.

Human Rights Watch (HRW) in its report “We are a Buried Generation: Discrimination and Violence Against Sexual Minorities in Iran,” released last month stated that because trials on moral charges in Iran are usually held in camera, it is difficult to determine what proportion of those charged and executed for same-sex conduct are gay and in what proportion the alleged offense was consensual.

Because of the lack of transparency, Human Rights Watch said: "it cannot be ruled out that Iran is sentencing sexual minorities who engage in consensual same-sex relations to death under the guise that they have committed forcible sodomy or rape."

Their report also documents serious abuses, including due-process violations that occurred during the prosecution of sexual minorities charged with crimes.

Those charged with engaging in consensual same-sex offenses stand little chance, HRW say, of receiving a fair trial.

"Judges ignore penal code evidentiary guidelines in sodomy cases and often rely instead on confessions extracted through physical torture and extreme psychological pressure. Both Iranian and international law consider such evidence inadmissible."

As we noted yesterday, some Muslim organizations have argued that the death penalty is religiously as well as morally wrong.

An international coalition of Muslim organizations (the Association of British Muslims (AOBM), Faith Matters, Muslims for Progressive Values (MPV), USA and Canada, Canadian Muslim Union (CMB), Members of The Royal Order of Noor of Buayan, Canadian Council of Muslim Women (CCMW) and el-Tawhid Juma Circle) spoke out yesterday against the death sentence case in Piranshahr.

The International Gay and Lesbian Human Rights Commission (IGLHRC) has received reports of the imminent execution of two men in Piranshahr, Iran. By some media accounts, Ayub and Mosleh have been sentenced to death for raping a young man, filming their actions, and inserting images of President Ahmadinejad into the film. There have been reports that the men are scheduled to be killed by stoning on January 21. IGLHRC has been unable to confirm the allegations in this case.

This case is evidence, however, of much bigger problems in Iran: widespread abuse in the justice system and censorship of information. People, including those who are lesbian, gay, bisexual or transgender may be arbitrarily arrested, tortured, and convicted on baseless charges. It can be difficult, if not impossible, to know the facts that lie behind convictions.

IGLHRC condemns the use of capital punishment in all instances, including this one, regardless of the alleged acts with which the individuals have been accused or convicted. Likewise, IGLHRC condemns all forms of sexual violence and rape. We call on the Government of Iran to immediately annul any execution order related to this case, to end the practice of death by stoning, and to repeal the criminalization of same-sex activity.

"Iran has an impenetrable and opaque criminal justice system that makes knowing what is really happening inside the country impossible," said Hossein Alizadeh, Regional Coordinator for IGLHRC's Middle East and North Africa Program. "What we do know is that killing is wrong in all its forms, even when committed by the State."
