'We Do'
As same-sex marriage comes to Massachusetts, how deeper and broader trends have made the rest of the country more tolerant, too.

When Hillary Goodridge was a student at Dartmouth College in the 1970s and first “coming out” as a lesbian, the last thing she thought about was same-sex marriage. She saw herself as a lesbian separatist and an enemy of anything that smacked of traditional institutions. Back then, the issues that engaged her were the anti-nuclear and anti-apartheid movements. At one political rally, a 20-year-old Goodridge got up and shouted fiercely, “Marriage is a patriarchal institution!”
But as the years passed, Goodridge's life underwent significant changes. She became involved in a long-term relationship with Julie, her partner for the past seventeen years. She left New Hampshire and eventually moved to Boston, where she currently serves as program director of the Unitarian Universalist Funding Panel. Eight years ago, Julie gave birth to their daughter Annie. (Hillary, Julie, and Annie share the same surname, which they adopted just before Annie was born.) Annie's birth provided them with their first real encounter with the consequences of not being legally married. After problems developed following a planned Caesarian birth, Annie was rushed to the neonatal intensive-care ward. But when Hillary tried to see her, she was told she wasn't allowed. Hospital staff also barred her from visiting Julie in the post-op room. That wouldn't have been the case if they had been legal spouses. “It was really jarring,” she recalls.
Three years ago, Hillary and then-five-year-old Annie were discussing love and were naming various couples they knew who were married. Annie asked why she and Julie weren't married. “You don't love each other,” Annie said. “If you loved each other, you'd be married!”
Since then, both her mothers have been working hard to remedy the situation. In March 2001, they marched into Boston City Hall to apply for a marriage license.
“Where's the groom?” the clerk asked.
“We're two brides,” replied the Goodridges, glowingly, although they knew the outcome from the start.
The clerk told them they needed two grooms.
But the two women were determined to keep faith with Annie. The following month, they took the issue to court, joining six other couples as plaintiffs in the landmark case Goodridge v. Massachusetts Department of Public Health challenging Massachusetts laws restricting same-sex couples from marrying. Remarkably, of the fourteen plaintiffs, seven are Unitarian Universalists. On November 18, 2003 , the state's highest court ruled by a 4-3 majority that “barring a person from the protections, benefits, and obligations of civil marriage solely because that person would marry a person of the same sex violates the Massachusetts constitution.” The court gave the legislature 180 days—until May 17—to comply. Then in February, the court reaffirmed its decision, making it clear that only marriage—not civil unions—would satisfy its earlier ruling.
The decision made Massachusetts the first state in the union to grant gays and lesbians full-fledged marriage rights, joining the Netherlands, Belgium, and the Canadian provinces of Ontario and British Columbia. In the months that followed, same-sex marriage seemed to be sweeping like a brushfire across the country. Gay and lesbian couples were camping out overnight and lining up in the rain in front of San Francisco City Hall for marriage licenses. A tiny county north of Albuquerque, New Mexico, handed out twenty-six same-sex marriage licenses before the state invalidated them. The mayor of New Paltz, New York, began officiating same-sex weddings without issuing licenses and faces nineteen misdemeanor charges as a result.
At the same time, the sudden possibility of same-sex marriage created a formidable backlash. Massachusetts legislators narrowly gave preliminary approval to a state constitutional amendment that would allow civil union status for same-sex couples but deny them the right to marry; if the legislature approves the same measure a year from now it would go to Massachusetts voters in 2006. Governor Mitt Romney of Massachusetts attempted to block the issuance of licenses on May 17. Ohio's governor signed a bill banning same-sex unions in his state, making Ohio the thirty-eighth state that explicitly bans same-sex marriage. In March, President George W. Bush announced he favored amending the United States Constitution to ban same-sex marriage. Some Republican political strategists sensed a “wedge” issue with which to attack Democrats in the November election. And the religious right saw a crusade against same-sex marriage as a way to revive its political fortunes.
Yet a renewed culture war pitting conservative Christians against the aspirations of same-sex couples appears unlikely to reverse a very real march of progress. Even though same-sex marriage isn't on the legal horizon in most states anytime soon, American culture has come a very long way since the Stonewall riots that launched the gay movement thirty-five years ago.
The current cultural moment has not emerged from a vacuum. The attention of most heterosexual Americans—with perhaps the exception of the religious right—was focused on other matters. But notable shifts within the lives of people like Hillary Goodridge, within the lesbian, gay, bisexual, and transgender (LGBT ) community, and within the larger society have prepared the way for the national focus on same-sex marriage. Those shifts have been mirrored in Unitarian Universalism as well. Within the LGBT population, the transformation can be seen as the personal and political maturing of an entire community. At the same time, the larger society has shown increased toleration, if not acceptance, of gays and lesbians. As the two trends have come together, much of the country has witnessed the growing visibility and mainstreaming of the gay and lesbian community, an assimilation into the very core of American life that parallels the path of various ethnic minorities.
The growing acceptance of gays and lesbians in mainstream culture seemed particularly evident last summer and fall. During a period of a few months, the U.S. Supreme Court overturned state sodomy laws, the Canadian province of Ontario granted marriage rights to same-sex couples, the Episcopal Church elected the Rev. V. Gene Robinson as its first openly gay bishop, and millions of Americans were glued to TV shows like Queer Eye for the Straight Guy. In the wake of all this came the Massachusetts court decision. For advocates for gay rights, 2003 indeed seemed like a breakthrough year.
“Four years in the gay movement is like twenty-eight years in the rest of society,” says E.J. Graff, author of the Beacon Press book, What Is Marriage For? “We're living in dog time.”
In the early years of the gay rights movement, sexual liberation was the dominant concern for many gay men; at the same time, large numbers of lesbians, strongly influenced by the women's movement, focused on building their own community around feminist and anti-patriarchal values. For most gay men, marriage wasn't on their radar screen; for most lesbians, like Hillary Goodridge, marriage seemed inimical to the egalitarian new world they were trying to create.
But as the generation that came of age in the tumultuous and heady years of the 1960s got older, it found itself with radically changing needs. By the mid-to-late 1980s, AIDS was ravaging the gay male community, undercutting the sexual liberation ethos that had sustained many gay men; as a result, many men began focusing on long-term relationships. Among lesbians in the late 1980s, as the separatist ideology lost much of its power and women felt they had more personal and economic choices—and, in many cases, were approaching the end of their child-bearing years—a “baby boom” emerged. More and more, gays and lesbians were living lives very much like their heterosexual neighbors. Truth be told, many had always been doing so.
“The main factors that have led us where we are today are AIDS and the maturation of the core population of LGBT people who are politically attuned and motivated,” says Sue Hyde, New England field organizer for the National Gay and Lesbian Task Force. “Our needs for equality have changed as we become older and more settled and become parents.” Hyde notes that, of the 594,000 cohabiting same-sex couples who identified as such on the 2000 United States census, 34 percent of lesbian and 22 percent of gay male couples had children under 18 at home.
Hyde says that activists now in their forties and fifties remain at the forefront of the gay rights movement today. So, not surprisingly, their issues—focused on relationships, family issues, and children—have taken center stage. Hillary Goodridge, now 47, says, “Having kids gives you a fierce, very primal feeling around protection of your family that I didn't realize before. I feel protective about my partner Julie, but it is my daughter Annie who brings out a ferocity.”
“The formation of families is so different today than in the '60s and '70s,” says Rob Compton, who, along with his partner, was one of the plaintiffs in the Massachusetts case. “At that time, if you wanted to have kids, the only option was a traditional family. Many gay people ignored their gay side for that reason. But in the past few years, so many of our gay friends have adopted children. It is really amazing.” Compton himself was married to a woman for many years in order to have the kind of family he wanted. Compton, 54, and his partner, David Wilson, 59, have been together for seven years. Between them, they have five children from previous heterosexual marriages, and six grandchildren.
As the gay and lesbian communities came to look more and more like mainstream America, society also began seeing homosexuality in a new light. Although many early responses to the AIDS epidemic portrayed gay men as sources of contagion, the epidemic also prompted a much wider and more compassionate depiction of homosexuality in the media. More gay men and lesbians came out of the closet, organizing community-based aids service organizations and agitating for greater government action. The AIDS Quilt was first displayed at the second gay and lesbian march on Washington, D.C., in 1987 and generated tremendous sympathy and support. “The quilt was a significant turning point,” Hyde says. It changed the “you got what you deserved” approach to aids to a more sympathetic view of gay people, emphasizing the grief of an entire community.
At the same time, gay and lesbian family issues were gaining attention politically. Various cities passed domestic partnership ordinances that offered health and insurance benefits to partners of gay and lesbian municipal employees. In 1992, Vermont became the first state in the union to approve domestic partnership benefits for same-sex partners of state workers. A variety of companies, notably in the health-care and high-tech industries, began to include same-sex partners in their benefits packages. The decisions of Vermont and Massachusetts courts to legalize second-parent and step-parent adoption by a same-sex partner helped lay the legal groundwork for the later civil union and same-sex marriage decisions in those states.
Despite these shifts, it took time for the idea of same-sex marriage to take hold, especially in urban gay communities. When I traveled around the country researching my book In Search of Gay America, published in 1989 , I was surprised at the number of gay and lesbian couples I met who had been “married” or “joined in holy union”—sometimes in Unitarian Universalist congregations but primarily in churches that ministered specifically to the gay community, like the Metropolitan Community Church. Same-sex marriage, I wrote, was “a phenomenon rarely found in larger cities, perhaps because the pressure to fit in is not as strong there.”
It was the election of Bill Clinton as president in 1992 that marked the first major social shift on gay issues, ushering in a period E.J. Graff calls the “big thaw.” Promising “I have a vision and you're part of it,” the Arkansas governor actively sought the gay vote in his campaign for president. Once elected, Clinton announced he would issue an executive order ending the U.S. military's ban on gays and lesbians serving in the military. After an intense national debate the Clinton administration retreated, instituting the “Don't Ask, Don't Tell” policy.
Despite the outcome, the discussion focused attention on gay issues as never before. Gay subjects emerged dramatically in literature, theater, and movies, culminating in Tom Hanks' Oscar for his role as a gay lawyer with AIDS in the film Philadelphia. Unprecedented visibility humanized a previously ignored and despised group of people. On April 25, 1993, hundreds of thousands of gays and lesbians came to the District of Columbia for the Third Lesbian and Gay March on Washington.
Not surprisingly, gays in the military was the major issue of that April 1993 march. But the march marked the first time that same-sex marriage gained some notice, as well. On the day before the march, the Rev. Troy Perry, founder of the Metropolitan Community Church, married 2,000 gay couples in a ceremony on the steps of the Internal Revenue Service building. Although the event was largely obscured by the march itself, for those who participated it was a transforming occasion.
“I remember going down to escalators to catch the Metro to the IRS,” recalls Aleta Fenceroy of Omaha, who married her partner Jean Mayberry at that ceremony, “and the whole subway tunnel burst out with people singing ‘Going to the Chapel.' It was one of those moments that still gives me goose bumps when I think of it.” Later that day, she and Mayberry walked around Dupont Circle with wreaths of flowers in their hair, receiving the congratulations of strangers.
That year, same-sex marriage became a public issue for the first time—and provoked a major public backlash. The Hawaii Supreme Court ruled that the denial of marriage licenses to three same-sex couples represented discrimination on the basis of sex. The state legislature moved quickly to define marriage as only between a man and a woman; five years later, in a hard-fought referendum, almost 70 percent of Hawaii voters passed a constitutional amendment ratifying the legislature's decision. In the years following the Hawaii ruling, thirty-eight states and the federal government passed legislation defining marriage exclusively as a heterosexual province.
For gay activists, Hawaii was a crushing defeat, but for a brief, shining moment, same-sex marriage suddenly seemed possible to millions of gay Americans. Gradually, a subject that had been near the bottom of the gay agenda began to move towards the top. And, E.J. Graff says, in the period following “the big thaw” the “silent majority” of gay people in much of the country were finally able to be more public about their sexual orientation without fear of losing jobs and family.
“They are the ones who were raising kids, who were taking care of their elderly mom upstairs,” Graff says. “They are no longer making the ‘devil's bargain'—‘I live like I'm gay but I don't say it.' They suddenly had a voice. They want to get married, and they want to get married for the same reason their brothers and sisters do.” Although division still exists within the gay and lesbian communities over the push for marriage—with some still expressing reservations about having the state define their relationships—same-sex marriage became a grass-roots issue, one that directly touched the lives of gay people, as few issues had before.
And then in 1999 came an event more momentous in terms of the legal recognition of gay couples than anything that had occurred before. In December of that year, the Vermont Supreme Court ruled that the exclusion of same-sex couples from the benefits granted to married people violated the state constitution. A year later, after a highly contentious political debate, Vermont adopted the nation's first civil unions law, granting same-sex couples the same state rights as married couples in terms of probate, medical benefits, child custody, and inheritance. Civil unions might have been “separate but equal” but they were a giant step forward.
The outcome spurred Hillary and Julie Goodridge, Rob Compton and David Wilson, and five other couples into action in Massachusetts, along with the Boston-based legal organization, Gay and Lesbian Advocates and Defenders, which had played a key role in the Vermont decision. If they could say “I do” in Vermont, why not in Massachusetts? And, this time, they were determined, full-fledged same-sex marriage would be the result.
Back in 1973, when the Rev. Leslie Westbrook was a 27-year-old assistant minister at the Arlington Street Church in Boston, two young women came to her and asked her to perform “a ceremony of love.” They sat in front of her, holding hands, under a large portrait of William Ellery Channing, the great Unitarian minister who had served the congregation more than a century before. They loved each other, the two women told Westbrook; they wanted to tell the world of their love. The young minister liked them both and was impressed by the way they related to one another. For Westbrook it was something entirely new: She was in her first month in the ministry and had never performed a single wedding or taken a course on the subject in theological school. And yet, she recalled in a sermon that she delivered last year at the Cedar Lane Unitarian Universalist Church in Bethesda, Maryland, “It didn't seem unusual to me, it seemed normal as apple pie, that I and the two women sitting with me under Channing's portrait were discussing their relationship and their wedding plans.”
Unitarian Universalists were out ahead of most other religious denominations in performing same-sex unions. According to the Arlington Street Church marriage book, three celebrations of love were performed there in 1973 and 1974, all of them for female couples. Although it is unclear which minister first blessed a same-sex union, a number of ministers are known to have officiated at ceremonies in the early 1970s, if not earlier.
Nonetheless, over the years, the UUA has reflected many of the same ambivalences—and often prejudices—about homosexuality as the rest of society. In 1967, the UUA Committee on Goals published the results of a survey that showed that 8 percent of UUs believed that homosexuality should be discouraged by law; 80 percent believed it should be discouraged by education; 12 percent believed it should be discouraged by either law or education. The key word was “discouraged.” Only 1/10 of 1 percent believed it should be encouraged.
For gay clergy, it was a particularly difficult time. The Rev. Eugene Navias remembers the years in the 1960s and '70 s when the only way to survive in the UUA was to be in the closet. “Come out in the UUA? Are you kidding?” he says. “The Department of Ministry was dead set against it. They shipped you out of the ministry as soon as they found out you were gay.” Navias, now 75, says, “Part of the price of the closet was that I could never have a committed partner. Although I saw gay men in other lines of work partnering and living together, I never saw that among the clergy.”
In 1980, the UUA General Assembly passed a resolution calling for nondiscrimination in ministerial employment regarding gays and lesbians. While some churches like Arlington Street felt comfortable performing same-sex unions, that certainly wasn't true everywhere. In the late '70s and ' 80s, as the numbers of same-sex unions performed by UU ministers increased, some ministers faced opposition from their congregations, according to the Rev. Keith Kron, director of the UUA's Office of Bisexual, Gay, Lesbian, and Transgender Concerns. Some ministers were asked at job interviews whether they'd perform such unions. In 1984, the General Assembly faced the issue directly, passing a resolution supporting services of union. Much of the controversy surrounding them died down within a few years.
In 1997, the General Assembly endorsed the rights of gays and lesbians to marry, with 97 percent of the delegates voting in favor. These days, Kron notes, some ministers have gone so far as to refuse heterosexual marriage licenses until same-sex marriage becomes legal; approximately thirty UU ministers have done so. Yet clearly there is still some ambivalence. While many Unitarian Universalists in Massachusetts may see the issue of same-sex marriage as “their civil rights battle,” Kron says, in some more conservative parts of the country, UU congregations and ministers can be as reluctant as their neighbors to embrace the issue.
For Rob Compton and David Wilson, the support of their Unitarian Universalist congregation—Boston's Arlington Street Church—has made a huge difference in their lives. Back in October 2000, the couple had a commitment ceremony at Arlington Street, presided over by the openly lesbian senior minister, the Rev. Kim K. Crawford Harvie. Three years later, on the day that the Massachusetts Supreme Judicial Court issued its ruling on same-sex marriage, the doors to the church were open for prayer and meditation; that night, the Freedom to Marry Coalition held a celebration there. “That is just another example of a UU church being welcoming,” says Wilson.
On May 17, the first day that same-sex marriage will be legal in Massachusetts, Compton and Wilson will go to Boston City Hall to apply for a marriage license. (After the required three-day waiting period, Crawford Harvie will sign it.) Then, if all goes as planned, on October 8, the anniversary of their commitment ceremony, the couple will return to the church to renew their vows. There will be a candlelight ceremony and a reception. But one major thing will be different on their fourth anniversary: This time, their minister will bless their Massachusetts wedding license.
If you look at American society today, you see a landscape unimaginable twenty-five or even ten years ago—a country where network and cable TV shows feature witty and appealing gay and lesbian characters (Ellen DeGeneres, the openly lesbian comic whose sitcom character came out to much controversy in 1998, has reinvented herself as one of the most popular daytime TV talk show hosts), where thousands of same-sex couples walk around with marriage licenses authorized by the city of San Francisco and by Multnomah County, Oregon, and where thousands of others in Massachusetts plan their weddings.
But the social and political landscape is complicated as well, with wide differences in attitudes towards homosexuality among regions, generations, religious groups, and urban and rural areas. Reality TV shows or sitcoms like Will and Grace that depict gays and lesbians in a positive light may open people's eyes a bit, but not everyone has been watching—or marching in lockstep. As political organizer Hyde points out, “To imagine [that] Queer Eye for the Straight Guy or a show about finding a boyfriend will generate fundamental political change is magical thinking.”
And, in every poll, Americans remain solidly opposed to the legalization of same-sex marriage, in some cases by two-to-one majorities. The numbers of support have moved only slightly in the past ten years, often falling during periods of backlash. Even a New York Times/CBS poll last July, which showed that 54 percent of Americans favored legalizing “homosexual relations,” revealed strong opposition to same-sex marriage.
Alan Wolfe, director of the Boisi Center for Religion and Public Life at Boston College, argues that while society is increasingly tolerant towards gays and lesbians, tolerance only goes so far. “Americans support the right to privacy,” he says. “They will look the other way. But if it is a public phenomenon, which marriage is, people see it as ‘in your face.' They don't like the idea, in spite of the overwhelming acceptance of homosexuality.” He adds that “the sea change in our culture—at least on TV—hasn't extended to same-sex marriage. Marriage is still viewed as a sacred event that has to do with raising children.”
Since the Massachusetts court decision, civil unions—once a radical position that nearly caused the state of Vermont to explode into civil strife—emerged as a “moderate” compromise for many voters and politicians in that state. All the Democratic candidates in the 2004 presidential race supported civil unions, and former senator Carol Mosely Braun, Rep. Dennis Kucinich, and the Rev. Al Sharpton endorsed full same-sex marriage rights.
Chris Bull, who has been covering politics for the past ten years as Washington correspondent for the gay biweekly newsmagazine, The Advocate, is equally doubtful that the Massachusetts court decision represents where the rest of the country is going—at least right now. In Massachusetts, Bull says, many years of activism and social change laid the groundwork on gay and lesbian issues. The state enacted a gay antidiscrimination law in 1989 (the third in the country after Wisconsin and New Hampshire) and under the liberal Republican Governor William Weld enacted legislation protecting the rights of gay high school students, a national first. A later court decision allowed second-parent adoption by same-sex partners.
“Massachusetts is more like Canada than it is like the rest of the country,” Bull says. “The state has a liberal population, the once-powerful Catholic church is under siege, there is no religious right to speak of. Those conditions have hardly been created in few other states. They haven't filtered down to the rest of the electorate.”
He suspects what we'll see in the rest of the country is a “patchwork approach,” with a few liberal-minded states perhaps legalizing same-sex marriage, and some states banning it outright. Bull argues that various states have to go through battles over gay nondiscrimination bills first, and undergo a ten-year cycle of “desensitization” on a variety of gay issues before they can cope with such a difficult issue as same-sex marriage. “Those states who have gone through the cycle already are ready for it,” he believes.
In some places the national controversy over same-sex marriage can make it harder to take those initial steps, as recent events bear out in Sioux City, Iowa, a town of 70,000 in the northwest part of the state. Six years ago the city council narrowly defeated an effort to add “sexual orientation” to the city's civil rights ordinance. This year, the Human Rights Commission proposed that the council take up the issue again. Some local gays and lesbians worried that the controversy over same-sex marriage would make it harder to change the city ordinance. “Everything that is happening in San Francisco could hurt our effort here,” cautioned Connie Jones, a Sioux City lesbian. “This marriage thing is coming so quickly. I'm afraid that people will be more reactive.” She was right. In late February, the city council rejected gay employment and housing protections by a 4-1 vote, with same-sex marriage a heated subject of discussion.
In Omaha, the nearest major urban area, the view is a little different, at least within the gay and lesbian community. Aleta Fenceroy, who was married at the March on Washington in 1993, sees a “pent-up euphoria” among gays and lesbians there, even though the state's constitution bars the recognition of same-sex marriages. “The reality of what nonrecognition means will happen at a later date,” says Fenceroy. “Right now people are caught up in the euphoria.”
Fenceroy seems to have caught the wave herself: She admits that she and her partner “considered hopping on a plane” to go to San Francisco to get a marriage license. But they thought better of it, especially since they already consider themselves married. “It would be fun to do a legal ceremony,” she says. “But unless it is recognized in Nebraska, it isn't essential.”
Despite the current backlash, journalist Bull believes that in the long run acceptance of same-sex marriage nationwide is simply inevitable. There may be a lag time, but it will happen eventually, as indicated by polls that show younger voters generally in favor of extending marriage rights. “People dip their foot into the water [of equality] and pull it out,” Bull says. “Then they go back into the water. Maybe they are in the process of pulling it out now. But they'll go back again.” More importantly, he argues, any group that is fighting for its own rights will win in the end. “They will be more vigilant than those against.”
In the end, beyond politics, beyond social changes and social movements, a greater force may help to transform the landscape. “The real push towards marriage isn't financial or legal,” says author Graff. “That is the easiest way to argue it, of course. But the ordinary Jane and Joe Homo, the 'silent majority,' they want to do this because they fall in love and marriage is an expression of love. The real oomph of the movement comes from this—people fall in love and want to get married!” And love may just be unstoppable.

Σε μια σειρά από χώρες της Ευρωπαϊκής Ένωσης (Βέλγιο, Ολλανδία, Μεγάλη Βρεταννία, Ισπανία κτλ), σε πολιτείες των ΗΠΑ (Μασσαχουσέττη, Βερμόντ κτλ) σε χώρες όπως η Νότια Αφρική (με απόφαση του Ανωτάτου Δικαστηρίου) έχει νομιμοποιηθεί η συμβίωση ατόμων του αυτού φύλου. Το όλο θέμα έχει λάβει κοινωνικές διαστάσες και στην Ελλάδα, τα δε αιτήματα από σχετικές οργανώσεις αλλά και ευρύτερους κοινωνικούς κύκλους για νομιμοποίηση της συμβίωσης αυτής είναι έντονα. Ερωτάται ο κ. Υπουργός εάν η Κυβέρνηση προτίθεται να προχωρήσει στις σχετικές επεξεργασίες για να αναγνωρίσει νομοθετικά τη συμβίωση ατόμων του αυτού φύλου και να τους χορηγήσει τα ανάλογα δικαιώματα περιουσιακά, φορολογικά, κληρονομικά, συνταξιοδοτικά ιατροφαρμακευτικής περίθαλψης κτλ

Σταμάτησε το AIDS - Κράτα την υπόσχεση
H 1η Δεκέμβρη έχει οριστεί ως η παγκόσμια ημέρα κατά του aids υπενθυμίζοντας σε όλους ότι το aids και οι συνέπειές του συνεχίζουν να υπάρχουν στην καθημερινότητα μας. Οι Μη Κυβερνητικές Οργανώσεις ΟΛΚΕ, ACT-UP, ΚΕΝΤΡΟ ΖΩΗΣ, PRAKSIS, MOSAIC που δραστηριοποιούμαστε ενεργά στην Ελλάδα, ενώνουμε τις δυνάμεις, τη φωνή και τις προθέσεις μας και οργανώνουμε κοινές εκδηλώσεις ενημέρωσης, ευαισθητοποίησης και συμμετοχής. Με το φετινό σύνθημα «Σταμάτησε το aids-κράτα την υπόσχεση» η UNAIDS προβάλλει την παγκοσμιότητα του ζητήματος του aids και ζητά την ανάληψη ευθυνών και την ανταπόκριση σε δεσμεύσεις του πρόσφατου παρελθόντος σε ατομικό, εθνικό και παγκόσμιο επίπεδο. Η φετινή εκστρατεία επικεντρώνεται στη συνεργασία όλων των δομών της κοινωνίας, αρχή που ασπαζόμαστε και κάνουμε πράξη μέσα από τη φετινή δική μας συνεργασία. Διανομή ενημερωτικού υλικού από ειδικευμένους εθελοντές που είναι σε θέση να παρέχουν πληροφορίες σχετικά με την hiv λοίμωξη και το aids «Φτιάξε το δικό σου κόκκινο κορδελάκι» θα προσφέρονται υλικά ώστε όλες και όλοι να φτιάξουν το δικό τους κόκκινο κορδελάκι και να ενημερώνονται σχετικά με την σημασία και τον συμβολισμό της κόκκινης κορδέλας. «Στείλε το δικό σου μήνυμα» Όλες και όλοι θα μπορούν να ζωγραφίσουν ή να γράψουν σε ειδικά χαρτόνια ένα μήνυμα σε σχέση με τον hiv/ aids. Τα χαρτόνια αποτελούν μέρη ενός τεράστιου παζλ στο σχήμα της υδρογείου σφαίρας και της κόκκινης κορδέλας προβάλλοντας με εικόνα την παγκοσμιότητα αλλά και τη σημασία της επαγρύπνησης για το ζήτημα του aids. Παρουσία χορευτικού και μουσικού συγκροτήματος ethnic αφρικανικής μουσικής.

Κοινωνικές Διαστάσεις της Ασθένειας
Κάθε άτομο αναπτύσσει κάποιες απόψεις ή αντιλήψεις σχετικά με διάφορες ασθένειες, βασιζόμενο κυρίως σε όσα έχει ακούσει ή διαβάσει γι' αυτές και σε όσα βιώνει προσωπικά κατά τη διάρκεια της ζωής του. Η υποκειμενική εμπειρία του ατόμου για τις απειλές της υγείας του θεωρείται μια από τις κυριότερες κοινωνικές παραμέτρους της ασθένειας. Η συμπεριφορά ενός ατόμου κατά τη διάρκεια της ασθένειας του εξαρτάται και επηρεάζεται από τα εκάστοτε πολιτισμικά δεδομένα. Άλλοι παράγοντες που εμπλέκονται και συντελούν στην διαφοροποίηση της συμπεριφοράς ενός ατόμου -κατά τη διάρκεια της ασθένειας του- είναι το φύλο του, οι διάφορες όψεις της προσωπικότητάς του, καθώς και άλλοι κοινωνικοί και πολιτισμικοί παράγοντες (Ραβάνης, 1995).
Οι υποκειμενικές αντιδράσεις στην ασθένεια περιλαμβάνουν μεγάλο εύρος στάσεων και συμπεριφορών. Έτσι κάθε ασθενής αντιλαμβάνεται και υπολογίζει διαφορετικά τα συμπτώματα μιας ασθένειας δημιουργώντας παράλληλα μια συμπεριφοράς απέναντι σ' αυτή (Ραβάνης, 1995).
Πολύ συχνά όμως, οι αντιδράσεις στην ασθένεια εξαρτώνται από τα χαρακτηριστικά της ίδιας της ασθένειας. Τέτοια χαρακτηριστικά είναι, σύμφωνα με τον Ραβάνη (1995):
α. η διάρκεια και εξέλιξη της ασθένειας,
β. η έκβαση και η πιθανότητα ίασης,
γ. ο βαθμός προκαλούμενης ανησυχίας (λόγω της αρρώστιας),
δ. το πιθανό κοινωνικό στίγμα.
Τα χαρακτηριστικά αυτά αποτελούν παράγοντες που μπορούν να επηρεάσουν τη συμπεριφορά και τη στάση του ασθενούς.
Σε αυτά μπορούν να προστεθούν και κάποια άλλα χαρακτηριστικά, όπως (Παπαδάτου και Αναγνωστόπουλος, 1995):
α. Η σοβαρότητα της νόσου,
β. Η προσωπική ευθύνη του πάσχοντος στην πρόκληση της αρρώστιας και στη θεραπεία της,
γ. Η ικανότητα ελέγχου της κατάστασης από το ίδιο το άτομο.
Συνδυάζοντας τα παραπάνω στοιχεία, οι Παπαδάτου και Αναγνωστόπουλος (1995) διακρίνουν τους εξής τύπους ασθένειας:
α. την οξεία ασθένεια βραχείας διάρκειας
β. την μακρόχρονη ασθένεια που δεν συνεπάγεται κοινωνικό στίγμα
γ. την ασθένεια μακράς διάρκειας που επισύρει κοινωνικό στιγματισμό,
δ. την πνευματική ασθένεια.
Στην πρώτη περίπτωση ασθενειών τα πράγματα φαίνονται αρκετά ξεκάθαρα αφού μια αρρώστια τη συνοδεύεται από γνωστά και σαφή συμπτώματα με συγκεκριμένη θεραπεία. Στην περίπτωση όμως των χρόνιων ασθενειών η κατάσταση δεν είναι τόσο ξεκάθαρη αφού όχι μόνο η διάρκεια και η εξέλιξη της ασθένειας δεν μπορούν να προβλεφθούν, αλλά ούτε επίσης οι κοινωνικές της επιπτώσεις.Η διαφορά ανάμεσα στους δύο τύπους χρόνιων ασθενειών έγκειται στο ότι σ' αυτές που δεν επισύρουν κοινωνικό στίγμα, ο ασθενής μπορεί να έχει έναν σχετικό έλεγχο στον τρόπο ζωής του ενώ αντίθετα, οι ασθένειες με κοινωνικό στίγμα έχουν διαφορετική μορφή. Αυτό συμβαίνει γιατί τα στιγματισμένα άτομα αναγκάζονται να περιορίζουν τις κοινωνικές τους δραστηριότητες εξαιτίας της ασθένειας τους, ενώ δεν είναι λίγες οι φορές που αποχωρούν από τη δουλειά τους ή το δημόσιο βίο τους γιατί έρχονται αντιμέτωπα με την εχθρότητα των άλλων.
Κοινωνικές Διαστάσεις της Λοίμωξης και Νόσου HIV
Το AIDS μπορεί να θεωρηθεί ασθένεια μακράς διάρκειας που επισύρει κοινωνικό στιγματισμό. Οι εργασιακοί και κοινωνικοί διωγμοί που υφίστανται οι φορείς του ιού και οι ασθενείς του AIDS αποτελούν απόδειξη γι' αυτό. Καμιά από τις ασθένειες που εμφανίστηκαν κατά τη διάρκεια του αιώνα που διανύουμε καθώς και του προηγούμενου, δεν αναστάτωσε τόσο τις κοινωνικές δομές όλων των χώρων όσο το AIDS. Η κοινωνική κρίση που προκλήθηκε από τη νόσο οφείλεται στον τρόπο μετάδοσης της. Όπως έχει ήδη ειπωθεί, ο ιός του AIDS μεταδίδεται είτε με την ερωτική πράξη, είτε με την επαφή του αίματος υγιούς ατόμου με αίμα ασθενούς (π.χ. μετάγγιση). Το γεγονός της μετάδοσης της νόσου μέσω ερωτικής επαφής επανεισήγαγε ουσιαστικά την έννοια του κινδύνου για τη ζωή από την ερωτική πράξη, κάτι που είχε εξαφανιστεί από την εποχή που τα αφροδίσια νοσήματα έγιναν ιάσιμα και δεν αντιπροσώπευαν πια κίνδυνο για τη ζωή των ανθρώπων.
Η έκρηξη της πανδημίας της νόσου που υπενθυμίζει στην κοινή γνώμη με έναν οδυνηρό τρόπο ότι ο άνθρωπος είναι θνητός, αποσταθεροποίησε και εξακολουθεί να αποσταθεροποιεί τις κοινωνικές συμβάσεις. Η σύγχρονη κοινωνία αντέδρασε, αρχικά τουλάχιστον, με φόβο και αγνόησε τις κοινωνικές και οικονομικές συνέπειες της επιδημίας. Τα επιδημιολογικά χαρακτηριστικά της πανδημίας είναι: η ευρύτατη γεωγραφική διασπορά, η προσβολή του γενικού πληθυσμού, η αύξηση της ετεροφυλική διασποράς και τέλος η ταχεία επέκταση της επιδημίας σε γυναίκες (Δαρδαβέσης, 1999).
Είναι ευνόητο ότι μια επιδημία αυτής της έκτασης επηρεάζει σημαντικά τις ανθρώπινες σχέσεις και συμπεριφορές αφού συντελεί στη μεταβολή των κοινωνικών δεσμών και διαφοροποιεί τις μορφές αλληλεγγύης και αποκλεισμού. Ταυτόχρονα, προκαλεί οδυνηρές ψυχοσωματικές, κοινωνικές και οικονομικές επιπτώσεις στα άτομα τα οποία έχουν προσβληθεί από τον ιό (Δαρδαβέσης, 1999). Από το εύρος και την ένταση των επιπτώσεων δεν είναι φυσικά δυνατόν να μην επηρεαστεί και το οικογενειακό, φιλικό και ευρύτερο κοινωνικό περιβάλλον των οροθετικών ατόμων. Η εξάπλωση της επιδημίας της λοίμωξης και νόσου HIV επέφερε κοινωνικές αντιδράσεις όμοιες μ' αυτές που εμφανίστηκαν στις μεγάλες επιδημίες του περασμένου αιώνα. Σε πολλές χώρες, παρουσιάστηκε το φαινόμενο της διαμόρφωσης της στάσης απέναντι στη λοίμωξη και νόσο HIV σε σχέση με ετεροφυλοφιλικές προτιμήσεις ή ρατσιστικές και ομοφυλοφοβικές προκαταλήψεις. Έτσι, αντί να αντιμετωπιστεί σαν ιατρικό και κοινωνικό πρόβλημα, χρησιμοποιείται για την ανακάλυψη αποδιοπομπαίων τράγων (Υφαντόπουλος, 1996).
Στις ΗΠΑ, αλλά και σε άλλες περιοχές, συντηρητικές θρησκευτικές οργανώσεις -οι οποίες διακινούν τεράστια χρηματικά ποσά και ασκούν πολιτική πίεση, έχοντας παράλληλα απήχηση στις λαϊκές μάζες- υποστήριξαν ότι το AIDS είναι θεϊκή τιμωρία. Αντί λοιπόν η συλλογική προσπάθεια να επικεντρωθεί στην επίλυση των προβλημάτων, σπαταλήθηκε στην αποκάλυψη και τον στιγματισμό των ενόχων (Υφαντόπουλος, 1996).
Μια άλλη κοινωνική επίπτωση του AIDS είναι η αντίδραση προς τις φιλελεύθερες σχέσεις που υιοθετήθηκαν τα τελευταία χρόνια. Στην περίοδο αυτή, οι θεσμοί, οι αξίες και οι διαπροσωπικές σχέσεις έγιναν λιγότερο παραδοσιακές και συντηρητικές. Επιπλέον, η ηθική διαφοροποιήθηκε από την θρησκεία και τις θρησκευτικές πεποιθήσεις ενώ καλλιεργήθηκε η ανεκτικότητα για μη παραδοσιακούς τρόπους κοινωνικής, πολιτισμικής και σεξουαλικής συμπεριφοράς. Το AIDS έγινε αφορμή να αμφισβητηθεί αυτός ο προσανατολισμός (Υφαντόπουλος, 1996).
Μια άλλη συνέπεια του AIDS ήταν ο διαχωρισμός των θυμάτων σε "αθώα" και "ένοχα". Αθώοι θεωρήθηκαν οι άνθρωποι που μολύνθηκαν κατόπιν μετάγγισης αίματος και παραγώγων του και τα παιδιά οροθετικών ατόμων, ενώ ένοχοι οι τοξικομανείς και οι ομοφυλόφιλοι. Ο στιγματισμός ανθρώπων με AIDS θα μπορούσε να οδηγήσει στον αποκλεισμό τους από τις υπηρεσίες υγείας και κοινωνικής περίθαλψης (Μόνος, 1991).Η ετεροφυλική διασπορά δραματοποιεί κυριολεκτικά το ρόλο της γυναίκας και του παιδιού στην οικογένεια και στην κοινωνία. Εκτός από τα παιδιά που έχουν μολυνθεί και θα πεθάνουν, πρόβλημα δημιουργείται και γι' αυτά των οποίων οι γονείς είναι φορείς της λοίμωξης HIV ή νοσούν ήδη. Έτσι πολλά παιδιά μένουν ορφανά, ενώ προβλήματα δημιουργούνται και με τα μολυσμένα παιδιά τα οποία δεν θα μπορούν να αξιοποιηθούν σαν εργατικό δυναμικό μιας χώρας μελλοντικά.Η λοίμωξη HIV αποτελεί μια ασθένεια που επιβαρύνει συνεχώς το σύστημα υγείας με χρήστες υπηρεσιών υγείας νεανικής ηλικίας (Σιγάλας, 1998). Το 90 % των ενηλίκων που έχουν μολυνθεί από τον HIV βρίσκεται στις ηλικίες μεταξύ 24 και 44 ετών. Τα άτομα αυτών των ηλικιών αποτελούν κατά κύριο λόγο το πλέον παραγωγικό τμήμα του πληθυσμού και το συστατικό στοιχείο του εργατικού δυναμικού κάθε χώρας (Σιγάλας, 1998).
Έτσι ένα μεγάλο τμήμα του συνολικού πληθυσμού το οποίο δεν είχε προβλεφθεί ότι θα χρειαστεί τις υπηρεσίες υγείας, έχει ανάγκη από φροντίδα με υψηλό οικονομικό κόστος. Εκτός όμως από το άμεσο οικονομικό κόστος, υπάρχει και το έμμεσο που απορρέει από τις επιπτώσεις της ασθένειας στον ίδιο τον ασθενή, στην οικογένεια του, στην παραγωγικότητα του, αλλά και στο κοινωνικό σύνολο - σαν αποτέλεσμα της απομάκρυνσης νέων ατόμων από την παραγωγική διαδικασία. Το έμμεσο κόστος είναι αυτό το οποίο είναι και πιο δύσκολο να εκτιμηθεί (Σιγάλας, 1998).
Τα κοινωνικά προβλήματα που έχουν ανακύψει από την λοίμωξη και νόσο HIV πρέπει να αντιμετωπισθούν άμεσα προκειμένου να στηριχθεί η δομή της κοινωνίας. Καθίσταται επιτακτική λοιπόν η ανάγκη αφενός κατάλληλης οργάνωσης της φροντίδας ασθενών με λοίμωξη HIV και αφετέρου ορθολογικής κατανομής των υφισταμένων πόρων, σύμφωνα με τις ανάγκες των ασθενών καθώς και με το παραγόμενο έργο από τις υπηρεσίες υγείας (Σιγάλας, 1998). Επιπλέον, θα πρέπει να εξευρεθούν τρόποι με τους οποίους οι άνθρωποι να μπορούν να εξερευνήσουν μια σειρά από ασφαλείς, ακίνδυνες, σεξουαλικές επιλογές διατηρώντας παράλληλα την ευθύνη τους για την υγείας των άλλων (Υφαντόπουλος, 1996).
Η Λοίμωξη και Νόσος HIV ως Μεταφορά του "Κακού"
Οι νόσοι έχουν συχνά χρησιμοποιηθεί ως συμβολικές έννοιες που σχετίζονται με αυτό που η εκάστοτε κοινωνία θεωρεί, ηθικά ή κοινωνικά, κακό. Έτσι, χρησιμοποιούνται ως μεταφορές του "κακού". Το φαινόμενο αυτό είναι περισσότερο έντονο στις περιπτώσεις ασθενειών με ασαφή αιτιολογία. Σύμφωνα με την Sontag (Σηφακάκη, 1995, σελ. 140) "η γλώσσα που χρησιμοποιείται για μια νόσο εξελίσσεται και τροποποιείται ανάλογα με το βαθμό γνώσης μας για τα αίτια της καθώς και τους τρόπους θεραπείας της". Πριν από μερικά χρόνια, η νόσος που χρησιμοποιείτο κυρίως ως μεταφορά του κακού ήταν ο καρκίνος. Τα τελευταία χρόνια όμως, η εμφάνιση του AIDS, μιας ασθένειας όχι πλήρως κατανοητής, αφαίρεσε μέρος της χρήσης του καρκίνου ως μεταφοράς. Εκφράσεις όπως AIDS - μάστιγα του αιώνα, AIDS-λαίλαπα, AIDS-κατάρα κτλ είναι ενδεικτικές του τρόπου με τον όποιο αντιμετωπίζεται η ασθένεια. Σύμφωνα πάντα με την Sontag, "ενώ οι κοινωνίες χρειάζονται να έχουν νόσους που να ταυτίζονται με το κακό και έτσι να μεταθέτουν την ευθύνη "στα θύματά" τους, είναι δύσκολο να έχουν περισσότερες από μία κάθε φορά". (Σηφακάκη, 1995, σελ. 140).
Οι λόγοι που το AIDS χρησιμοποιείται ως μεταφορά του κακού είναι αρκετοί:Το AIDS συνδέεται με την παράδοση του ατόμου σε ορισμένες απολαύσεις (π.χ. παρεκκλίνουσα σεξουαλικότητα) ή στο εθισμό σε ουσίες που είναι παράνομες (π.χ. ναρκωτικά). Η μετάδοση της νόσου με την σεξουαλική επαφή ή με την κοινή χρήση μολυσμένης βελόνας κρίνεται αυστηρά επειδή θεωρείται ως εκούσια πράξη για την οποία το άτομο αξίζει να τιμωρηθεί. Η συγκεκριμένη ασθένεια γίνεται αντιληπτή ως τιμωρία για τη μη ηθική σεξουαλική δραστηριότητα ή για άλλες κοινωνικά μη αποδεκτές συμπεριφορές. Οι ασθενείς θεωρούνται "ένοχοι" γιατί κατά κάποιο τρόπο οι ίδιοι προκάλεσαν την ασθένεια τους και απειλούν έμμεσα το περιβάλλον τους. Αντίθετα, τα παιδιά και τα άτομα που υποβάλλονται σε μεταγγίσεις θεωρούνται "αθώα" θύματα της απρόσεκτης συμπεριφοράς των άλλων (Παπαδάτου και Αναγνώστοπουλος, 1999, σελ. 127).Πολύ συχνά η νόσος HIV συνοδεύεται από την αποκάλυψη μιας ταυτότητας που το άτομο πιθανόν δεν επιθυμούσε να γίνει γνωστή τόσο στο οικογενειακό όσο και στο κοινωνικό του περιβάλλον. Γι' αυτό, δεν είναι σπάνιο φαινόμενο ο ασθενής να προσπαθεί να κρύψει τη διάγνωση από την οικογένειά του (Σηφακάκη, 1995).Όλες οι μολυσματικές νόσοι που η μετάδοση τους συνδέεται με την σεξουαλική συμπεριφορά προκαλούν ανυπόστατους φόβους για μετάδοση τους με τρόπους μη σεξουαλικούς. Για το AIDS ισχύει το ίδιο. Γενικώς, το AIDS συνέβαλε σημαντικά στην αλλαγή της αντιμετώπισης της σεξουαλικότητας κυρίως μετά από μια περίοδο πλήρους απελευθέρωσης. Όπως ισχυρίζεται η Sontag, οι μεταφορές έχουν αρνητικές συνέπειες επειδή παραμορφώνουν την εμπειρία της νόσου και επειδή αποτρέπουν τους ανθρώπους από την αναζήτηση της θεραπείας. Γι' αυτό θα έπρεπε όχι μόνο να αποφεύγονται, αλλά και να αποκαλύπτεται η λειτουργία τους (Σηφακάκη, 1995).Στις μέρες μας η επιστημονική πρόοδος έχει συμβάλει στην πληρέστερη κατανόηση της λοίμωξης και νόσου HIV με αποτέλεσμα αυτή να μην προκαλεί το δέος που προκαλούσε στην αρχή της εμφάνισής της. Παράλληλα, η ανακάλυψη καινούριων θεραπειών κατέστησε τη μοιραία νόσο χρόνια και άλλαξε το δυσοίωνο χαρακτήρα της έννοιας της συγκεκριμένης ασθένειας. Είναι χαρακτηριστική η αντικατάσταση του όρου AIDS από τον όρο νόσος HIV, η οποία παρατηρείται στη διεθνή βιβλιογραφία και στο διεθνή τύπο.
Λοίμωξη και Νόσος HIV και Κοινωνικός Αποκλεισμός
Ο κοινωνικός αποκλεισμός στην περίπτωση της λοίμωξης και νόσου HIV συνδέεται άμεσα με τις εξής δύο έννοιες:
α. την ανισότητα στην περίθαλψη και
β. την άρνηση προσφοράς υπηρεσιών.
Και οι δύο παραπάνω έννοιες έχουν πολλαπλές ηθικές και δεοντολογικές προεκτάσεις (Υφαντόπουλος, 1996).
α. Ανισότητα
Σύμφωνα με του οικονομολόγους, το αγαθό "υγεία" δεν μπορεί να αφεθεί στις δυνάμεις της ελεύθερης αγοράς. Αντίθετα, το κράτος πρέπει να εξασφαλίσει υπηρεσίες που θα καλύπτουν τις βασικές κοινωνικές ανάγκες. Στην περίπτωση της ασθένειας του AIDS, επειδή το κόστος είναι υψηλό, εάν δεν παρέμβει το κράτος για την κάλυψη της νοσοκομειακής και φαρμακευτικής περίθαλψης υπάρχει κίνδυνος να δημιουργηθούν επικίνδυνες για την κοινωνία ανισότητες αφού όσοι ασθενείς δεν θα μπορούν να καταβάλουν το αυξημένο κόστος της θεραπείας, θα αποκλείονται από το υγειονομικό σύστημα (Υφαντόπουλος, 1996). Πολύ σωστά λοιπόν παρεμβαίνει το κράτος και προσφέρει ιατρο-φαρμακευτική περίθαλψη χωρίς την οικονομική επιβάρυνση των φορέων και των ασθενών. Η ανισότητα στους ασθενείς του AIDS εκδηλώνεται με την επιφύλαξη στην επαφή και φροντίδα του ασθενή από το προσωπικό υγείας.
β. Άρνηση
Εκτός όμως από τις επιφυλάξεις του προσωπικού υγείας υπάρχουν και περιπτώσεις άρνησης και αποκλεισμού των ασθενών του AIDS από κάποιες βασικές υπηρεσίες υγείας. Η άρνηση παροχής νοσηλευτικών ή ιατρικών υπηρεσιών αφορά στην καθαριότητα του ασθενή καθώς και την ιατρική φροντίδα (π. χ. χορήγηση οξυγόνου) (Υφαντόπουλος, 1996). Η στάση αυτή του προσωπικού αποδίδεται στο φόβο μετάδοσης του ιού και αποδεικνύει την ελλιπή ενημέρωσή του. Για την ουσιαστική καταπολέμηση του φαινόμενου του κοινωνικού αποκλεισμού στα νοσοκομεία απαιτείται η συνεχής εκπαίδευση και η ενημέρωση του ιατρικού και νοσηλευτικού προσωπικού (Υφαντόπουλος, 1996)."Η έννοια του κοινωνικού αποκλεισμού και οι ανισότητες στην πρόσβαση για υγειονομική φροντίδα δημιουργούν την ανάγκη για περαιτέρω κοινωνική έρευνα που αφορά στην κοινωνική κάλυψη, στη φροντίδα και στην παροχή κοινωνικών και νοσοκομειακών υπηρεσιών πριν και μετά τη νοσηλεία" (Υφαντόπουλος, 1996, σελ.16).

Ο ΓΑΜΟΣ ΟΜΟΦΥΛΩΝ ΚΑΙ Ο ΕΛΛΗΝΟΚΑΝΑΔΙΚΟΣ ΠΑΡΟΙΚΙΑΚΟΣ ΤΥΠΟΣ

Με την κατάθεση στην (καναδική) βουλή του νομοσχεδίου περί αναγνώρισης του γάμου μεταξύ ατόμων του ιδίου φίλου, η εντατικοποίηση της διαμάχης παίρνει- όπως εξ άλλου αναμενότανε-μεγάλες διαστάσεις. Με τη μάχη, να δίνεται κυρίως από τους εναντίον της υιοθέτησης του νομοσχεδίου, τα επιχειρήματα, κι από τις δύο πλευρές, αρχίζουν να εντείνονται σε επίπεδο έκφρασης, αλλά και έννοιας.
Πολλές θρησκευτικές, κοινωνικές, ηθικές, νομικές, συνταγματικές, ανθρωπιστικές και άλλες αξίες επιστρατεύονται και ρίχνονται στη μάχη, που σκοπό έχει, από τη μια, την έκφραση των πιστεύω κι αξιών και από την άλλη, την επιρροή των βουλευτών, η ψήφος των οποίων θα καθορίσει την αλλαγή ή όχι του ορισμού του θεσμού του γάμου.
Μέχρι εδώ τίποτα το ανησυχητικό κι επιλήψιμο. Η οποιαδήποτε αλλαγή, που έχει σαν στόχο τον από χιλιετίες αποδεκτό ορισμό του γάμου δεν είναι κάτι εύκολο και ο καθένας έχει το δικαίωμα να επιδιώξει την επικράτηση των δικών του απόψεων, ειδικότερα όταν αυτές έχουν να κάνουν με βαθιά ριζωμένες αρχές κι αξίες. Εκείνο, όμως, που εκπλήσσει, είναι μια κάποια προσπάθεια της παρουσίασης των επιχειρημάτων εναντίον της υιοθέτησης του νομοσχεδίου σε βάσεις, που δεν έχουν τίποτα να κάνουν με την κεντρική ιδέα που ώθησε την παρουσίαση του στη βουλή.
Ως γνωστόν, η Καναδική κυβέρνηση ενέργησε μετά από μια σειρά δικαστικών αποφάσεων, που καθόρισαν πως ο περιορισμός του γάμου, μόνο μεταξύ ετερόφυλων, παραβιάζει τα ανθρώπινα δικαιώματα των ομοφυλόφιλων και κατόπιν της γνώμης του ανωτάτου δικαστηρίου, που αποφάνθηκε επίσης πως όντως ο νομικός ορισμός του γάμου, όπως ισχύει σήμερα (μόνο μεταξύ ενός ανδρός και μιας γυναικός), παραβιάζει τα δικαιώματα των παραπάνω.
Και εδώ είναι που το όλο θέμα κάπου χάνεται. Μη θέλοντας, ή, μη τολμώντας κανείς να αμφισβητήσει τα ανθρώπινα δικαιώματα των ομοφυλόφιλων, η αντιπαράθεση μετατοπίζεται σε άλλα επίπεδα, που σαφώς αφήνουν εκτός συζήτησης το κύριο θέμα: Πόσο είμαστε έτοιμοι, να αναγνωρίσουμε σε συνανθρώπους μας το δικαίωμα, να έχουν διαφορετικό σεξουαλικό προσανατολισμό από το δικό μας;
Είμαστε πραγματικά έτοιμοι σαν κοινωνία, να παραδεχθούμε ότι είναι πολύ πιθανόν άλλοι άνθρωποι, να διαφέρουν σεξουαλικά από εμάς, ή ακόμα, είμαστε προσκολλημένοι στην ιδέα ότι η ομοφυλοφιλία αποτελεί διαστροφή και ανωμαλία;
Δεν είναι λίγοι αυτοί που υποστηρίζουν ότι, η ομοφυλοφιλία είναι αποτέλεσμα κοινωνικής συναναστροφής και συνήθειας. Τις προάλλες, άκουγα σε παροικιακό ραδιόφωνο πως: «οι «τέτοιοι» μπορεί να γεννιούνται έτσι, αλλά είναι κι άλλοι, που γίνονται από διάφορες επιρροές, όπως κάποιος γνωστός της, που «κατάντησε τοιούτος», επειδή η μάνα του κι οι θείες του τον κτένιζαν με μπούκλες και τον παραχάιδευαν».
Η αντίληψη πολλών, δεν συμβαδίζει με την επιστημονική θέση πως η ομοφυλοφιλία είναι ένα βιολογικό φαινόμενο, που σε καμία περίπτωση δεν μπορεί να χαρακτηριστεί σαν «ανωμαλία», ή άλλη βιολογική διαταραχή.
Η άποψη των περισσοτέρων θρησκειών αντιβαίνει σε αυτή την επιστημονική θέση και χαρακτηρίζει τη σχέση μεταξύ ατόμων του ιδίου φίλου σαν μεγάλη αμαρτία. Ο Απόστολος Παύλος, σε μερικές από τις επιστολές του κατατάσσει τους αρσενοκοίτες στην ίδια κατηγορία με τους εγκληματίες, τους κλέφτες, τους μοιχούς και τους υπολοίπους αμαρτωλούς, που δεν πρόκειται να κληρονομήσουν την βασιλεία των ουρανών.
(Τώρα, πως ο όρος «αρσενοκοίτης» υπονοεί μόνο τους ομοφυλόφιλους (μα και οι γυναίκες δεν είναι «αρσενοκοίτες» αφού κι αυτές κοιμούνται με αρσενικούς;) εξηγείται μάλλον από το γεγονός ότι, οι επιστολές του αποστόλου απευθυνόταν αρχικά μόνο προς τους άντρες, μια κι οι γυναίκες της εποχής δεν φαίνεται να απολάμβαναν τα ίδια δικαιώματα τότε- μια άλλη μορφή διάκρισης, που έχει προ πολλού καταργηθεί.
Πολλές κοινωνίες μιας κάποιας συντηρητικής υφής, αρνούνται να αναγνωρίσουν την ύπαρξη της ομοφυλοφιλίας σαν μια άλλη μορφή της ανθρώπινης φύσης και την κατατάσσουν στα σκοτεινά κι απόκρυφα της ανθρώπινης κατάπτωσης και διαστροφής.
Κάτω από αυτές τις συνθήκες λοιπόν, ήταν τελείως αναμενόμενο πως η αντίδραση πολλών στην επέκταση ενός δικαιώματος- όπως αυτό του γάμου- σε άτομα που δεν χαίρουν της εκτίμησης τους, θα προκαλούσε τεράστιες και έντονες αντιδράσεις.
Η αντιπαράθεση, όμως, δεν εστιάζεται σε αυτές τις θέσεις και πεποιθήσεις, που αν πράγματι ακολουθούσε αυτές τις γραμμές, θα ήταν τουλάχιστον, αν όχι τι άλλο, διαλεκτικά έντιμη.
Ακούγεται συχνά, πως οι αντίθετοι προς το νομοσχέδιο δεν έχουν ουδεμία αντίρρηση στην αναγνώριση του δικαιώματος των ομοφυλοφίλων να διευθετήσουν το δικαίωμα της ένωσης τους με κάποια άλλη νομική κάλυψη, εκτός από αυτή του γάμου. Πολλοί, όμως, την ίδια στιγμή που αναφέρονται σε αυτό, παρεμβάλουν την απέχθεια τους προς αυτούς με το να τους ονομάζουν: «τοιούτους», «ανώμαλούς», «παρακατιανούς», καθώς κι άλλες ονομασίες, που δηλούν διάκριση, που στην ουσία είναι και η βάση των αντιρρήσεων τους.
Καταλαβαίνω, πως το θέμα δεν είναι καθόλου εύκολο. Οι προεκτάσεις του όλου ζητήματος καλύπτουν πολλές δυσκολονόητες έννοιες, οι οποίες, σε συνδυασμό με προκαταλήψεις αιώνων, καθιστούν την κατάσταση απίστευτα πολύπλοκη και ακαταλαβίστικη.
Άρα, ευκολότερο είναι να παραμείνει κανείς σε αυτά που γνωρίζει και νοιώθει, παρά να βολοδέρνεται σε μονοπάτια δύσβατα και οδυνηρά.
Η κοινωνία, όμως, αρνείται να παραμείνει στάσιμη, επειδή τα θέματα που παρουσιάζονται ενώπιον της είναι πολύπλοκα. Αντίθετα, επιδιώκει να ασχοληθεί ακριβώς με ότι έχει να κάνει με νέες έννοιες, αρχές και αξίες, στην αναζήτηση ενός καλύτερου κοινωνικού προσανατολισμού.
Εδώ λοιπόν, καλούνται να επέμβουν οι διανοούμενοι, οι οποίοι με την δική τους ικανότητα, γνώσεις και πάνω από όλα διαύγεια πνεύματος, θα επιδιώξουν να προσφέρουν κατευθύνσεις στους υπολοίπους. Φυσικά, ουδείς αναμένει ότι όλοι αυτοί θα τοποθετηθούν μονόπλευρα και πως οι πάντες θα συμφωνήσουν με τις προτεινόμενες αλλαγές. Απαιτείται, όμως, να προσφέρουν κάτι, που είναι απαιτητικά αναμενόμενο: Εντιμότητα στο διάλογο. Όσο μεγαλύτερη θέση οι διαπλεκόμενοι κατέχουν στη διανόηση, τόσο ποιο μεγάλη ευθύνη φέρουν στο τι λένε και πως το παρουσιάζουν. Ας μη ξεχνάμε, πως οι υπόλοιποι περιμένουν κατεύθυνση από αυτούς, η οποία όμως οφείλει να είναι ξεκάθαρη και πάνω από όλα απαλλαγμένη από επιχειρήματα που σκοπό έχουν την επιβολή των απόψεων τους, ανεξάρτητα της εγκυρότητας τους. Είναι πολύ εύκολο για κάποιον που κατέχει το θέμα πολύ καλά και που έχει μια εκτεταμένη παιδεία, να παραπλανήσει εσκεμμένα το ακροατήριο, αλλά τι βγαίνει με αυτό; Πόσο θα έχει προωθηθεί το θέμα και πόσο θα έχει συνδράμει στο πάρσιμο σωστών αποφάσεων;
Για παράδειγμα, ο αρχηγός της αξιωματικής αντιπολίτευσης, Στήβεν Χάρπερ, απεύθυνε μια σειρά μηνυμάτων προς τα μέλη των διαφόρων πολιτιστικών κοινοτήτων, που σκοπό είχαν την στράτευση τους στην αντίθεση προς το νομοσχέδιο. Σκοπός του κ. Χάρπερ δεν ήταν οπωσδήποτε να ευαισθητοποιήσει τους νέο-καναδούς στο διάλογο περί του νομοσχεδίου. Ποντάριζε περισσότερο, στη συντηρητική μορφή των κοινωνιών τους και στη μακροχρόνια αντίληψη περί ομοφυλοφιλίας που επικρατεί, στις χώρες από τις οποίες αυτοί προέρχονται.
Άλλοι σχολιαστές, παρουσιάζουν θρησκευτικές θέσεις περί της ομοφυλοφιλίας σαν μέρος των επιχειρημάτων τους, ακόμα και όταν οι ίδιοι δεν κατέχονται από θρησκευτικά πιστεύω.
Ορισμένοι, παραμένουν στην ετυμολογική έννοια του γάμου και στην χιλιόχρονη παράδοση, αρνούμενοι να λάβουν υπόψη τους την νομική πλευρά, καθώς και την ανθρωπιστική και απαιτούν την διεξαγωγή δημοψηφίσματος σαν τη μοναδική ενδεδειγμένη λύση.
Καθηγήτρια πανεπιστημίου, με ειδικότητα στην ιατρική δεοντολογία, προβάλει τα επιχειρήματα πως ο ορισμός του γάμου καθορίζεται: ένα, μόνο από την αναπαραγωγή του ανθρωπίνου γένους, δύο, την αντίληψη των εθνικιστικών μειονοτήτων (που η αλλαγή του ορισμού του γάμου θα τους προσβάλει και αποδέχεται τη θέση του κ. Χάρπερ, πως το νομοσχέδιο είναι απειλή εναντίον του οποιοδήποτε υποστηρίζει τον πολυπολιτισμό), τρία, πως μπορεί να οδηγήσει στην πολυγαμία – ή στην άρνηση της πολυγαμίας των γυναικών, που τότε θα αποτελέσει διάκριση εναντίον τους;;; και τέλος, στην εφαρμογή του άρθρου 33 του χάρτη ανθρωπίνων δικαιωμάτων, που προβλέπει την προσωρινή αναστολή της ισχύος αυτού, (notwithstanding clause).
Εκείνο, όμως, που όλοι παραγνωρίζουν (παρ’ όλο που η καθηγήτρια το παρουσίασε) είναι το προοίμιο του σχεδίου «Νόμος περί Πολιτικού Γάμου»:
«Η βουλή του Καναδά, αποφασισμένη να προασπίσει το δικαίωμα της ισότητας χωρίς διάκριση, αποκλείοντας τη χρήση του εδαφίου 33 του χάρτη των δικαιωμάτων και ελευθεριών προς άρνηση του δικαιώματος ζευγαριών του ιδίου φύλου να έχουν ίση πρόσβαση σε γάμο για πολιτικούς λόγους…».
Σε κάποια απόφαση του σχετικά με τα ανθρώπινα δικαιώματα, ο πρώην αρχιδικαστής του ανωτάτου δικαστηρίου, Αντώνιο Λαμέρ, είχε αναφέρει χαρακτηριστικά, λαμβάνοντας υπόψη τις διατάξεις περί διάκρισης του εδαφίου 15 του χάρτη δικαιωμάτων: « Από νομική άποψη, ο χάρτης έχει καθιερώσει βασικά την κοσμική φύση της Καναδικής κοινωνίας και την κεντρική θέση που παίρνει η ελευθερία της συνείδησης στη λειτουργία των δεσμών μας».
Ο υπουργός Δικαιοσύνης, Έργουην Κότλερ, αναφερόμενος στο νομοσχέδιο είπε πως πρόκειται περί: «δικαιωμάτων, δικαιωμάτων, δικαιωμάτων» για να καταλήξει ότι: «η εφαρμογή του εδαφίου 33 του χάρτη (notwithstanding clause) θα ήταν ουσιαστικά η αναγνώριση πως η κυβέρνηση καταπατά τα ανθρώπινα δικαιώματα».
Με λίγα λόγια, βλέπουμε πως το νέο νομοσχέδιο δεν εισέρχεται σε θέματα θρησκευτικά και άλλα σε σχέση με το γάμο, αλλά απλούστατα, επιδιώκει να διευθετήσει ένα καθαρά νομικό θέμα, που έχει προκύψει από την εφαρμογή του χάρτη δικαιωμάτων και ελευθεριών, που απαγορεύει τη διάκριση-μεταξύ άλλων- βάση το σεξουαλικό προσανατολισμό.
Ο καρδινάλιος της Ρωμαιοκαθολικής εκκλησίας, Αλόσιους Αμπρόζικ, όμως, μεταθέτει το θέμα αλλού: «Μέχρι τώρα, η συζήτηση έχει γίνει μεταξύ δικηγόρων. Είναι καιρός να αρχίσει μια συζήτηση με ολόκληρη την καναδική κοινωνία».
Και η συζήτηση, πρέπει να γίνει, από ολόκληρη την καναδική κοινωνία. Μια συζήτηση όμως, που οφείλει να επικεντρωθεί στο συγκεκριμένο θέμα: την επέκταση του ίδιου δικαιώματος σε όλα τα μέλη της καναδικής κοινωνίας εξ ίσου.
Η έννοια του γάμου, δεν είναι όσο απλή, όσο πολλοί θέλουν να νομίζουν. Οπωσδήποτε, ο ορισμός είναι τόσο πανάρχαιος όσο και η ίδια η κοινωνία. Πάντα, όμως, είχε να κάνει με τη επίσημη ένωση δύο ανθρώπων. Μια επισημότητα, που, μέχρι πρότινος, ήταν αποκλειστικό δικαίωμα της εκάστοτε θρησκείας στην οποία το ζευγάρι ανήκε. Και σαν θρησκευτική τελετή και μυστήριο, δεν θα μπορούσε να είχε προεκταθεί σε άτομα του ιδίου φύλου, εφόσον όλες οι θρησκείες θεωρούν την ομοφυλοφιλία αμαρτία. Η θρησκευτική κάλυψη του δεσμού όμως, είχε επιπλέον και νομική ισχύ. Επεκτεινόταν σε όλα εκείνα τα νομικά ζητήματα που καθόριζαν τη σχέση του ζευγαριού αναφορικά με τη πατρότητα των παιδιών, τη κληρονομιά, φορολογία κτλ. Η πολιτεία, ήταν ικανοποιημένη με τη θρησκευτική αντιμετώπιση του γάμου, μέχρι τη στιγμή που θρησκευτικοί περιορισμοί, ώθησαν πολλούς να αναζητήσουν τη νομική αναγνώριση του δεσμού τους εκτός εκκλησίας, ναού, συναγωγής, ή, οποιαδήποτε άλλου θρησκευτικού ιδρύματος
Φυσικά, η εισαγωγή του πολιτικού γάμου δεν αφαίρεσε το δικαίωμα της εκάστοτε θρησκείας να ευλογεί γάμους και ούτε στέρησε από αυτούς, τη νομική κάλυψη που απολάμβαναν. Απλά, δόθηκε η ευκαιρία σε εκείνους, που δεν θεωρούσαν υποχρεωτική και αναγκαία τη θρησκεία να καθορίζει τα του γάμου τους, να έχουν μια εναλλακτική λύση. Και τότε η θρησκεία αντέδρασε έντονα στην υιοθέτηση του πολιτικού γάμου. Αλλά, οι δυνάμεις του διαχωρισμού κράτους και εκκλησίας ήταν τόσο ισχυρές, καθώς και η κοινωνική πίεση τόσο μεγάλη, που τελικά αυτή η νέα μορφή γάμου επικράτησε.
Αργότερα, πολλά ζευγάρια, ακόμα και αυτό το δεσμό του πολιτικού γάμου δεν θεωρούσαν απαραίτητο και κατέληξαν σε συμβίωση χωρίς καμία επισημοποίηση. Πολλοί είναι αυτοί, που δεν πιστεύουν, πως η αγάπη που τους ενώνει, χρειάζεται κάποια επίσημη αναγνώριση για να είναι μόνιμη και έγκυρη. Η νέα αυτή τάση, υποχρέωσε στη συνέχεια το κράτος, να αναγνωρίσει τη νομική ισχύ αυτών των δεσμών και να προεκτείνει όλα τα νόμιμα δικαιώματα, που μέχρι πρότινος ίσχυαν για τους νόμιμα παντρεμένους και προς εκείνους, που απλά συζούσαν.
Εμφανώς πλέον, ο ορισμός του γάμου, αλλά και η έννοια του δεσμού δύο ατόμων, δεν είναι πλέον ο ίδιος με τον πανάρχαιο. Η εξέλιξη της κοινωνίας έχει κατά πολύ διαφοροποιήσει τα πράγματα και σήμερα, ο καθένας έχει το δικαίωμα της επιλογής.
Πάνε πλέον τα χρόνια που η κοινωνία εξοστράκιζε όσους δεν ακολουθούσαν την γενικά παραδεδεγμένη μορφή του γάμου. Ακόμα και η πατρότητα των παιδιών δεν αποτελεί πλέον θέμα κοινωνικής αποδοχής. Ο όρος «μπάσταρδος» έπαψε να έχει την έννοια του «αγνώστου πατρός» και χρησιμοποιείται τώρα για πολύ διαφορετικούς λόγους.
Έτσι λοιπόν, την εποχή τούτη, έχουμε τρεις μορφές ένωσης δύο ατόμων: τον θρησκευτικό γάμο, τον πολιτικό και τη συμβατική συμβίωση. Εκτός από το θρησκευτικό, που καθορίζει την ένωση δύο ατόμων σαν μυστήριο της ένωσης δύο ανθρώπων σε «σάρκα μία», οι υπόλοιποι δεν έχουν παρά μόνο ένα σκοπό: την ένωση ατόμων, καθώς και τη νομική διευθέτηση των σχέσεων τους. Προς αποφυγή δε παρερμηνειών, ο όρος που καθορίζει αυτή τη σχέση- παρ’ όλο που η μορφή έχει αλλάξει- παραμένει ο ίδιος: γάμος, με την προσθήκη του αναλόγου επιθέτου: θρησκευτικός, πολιτικός, συμβατικός, που στην πραγματικότητα, όμως, δεν άλλαζε τίποτα το ουσιαστικό στα μάτια του νόμου.
Με την υιοθέτηση των ανθρωπίνων δικαιωμάτων και την αποκήρυξη των διακρίσεων, μοιραία οδηγηθήκαμε στη διαπίστωση πως ένας όρος, που ίσχυε για μια μερίδα ανθρώπων, πρέπει, ο ίδιος, να ισχύει και για τους υπολοίπους. Ήταν δε μόνο θέμα χρόνου, οι υφιστάμενοι τη διάκριση να καταφύγουν στα δικαστήρια, απαιτούντες την ίδια μεταχείριση. Τα δικαστήρια, μη έχοντας άλλη επιλογή, εκδίκασαν υπέρ των αιτούντων και η κυβέρνηση, αν ήθελε να διατηρήσει τον παραδοσιακό και θρησκευτικό ορισμό του γάμου, δεν είχε άλλη επιλογή από την αναστολή της ισχύς των διατάξεων του χάρτη των δικαιωμάτων, παραβιάζοντας, επισήμως πλέον, τα ανθρώπινα δικαιώματα.
Το νομοσχέδιο που παρουσιάζεται, δεν επιδιώκει να υποχρεώσει τη κοινωνία να αποδεχθεί κάτι που δεν θέλει. Ο θρησκευτικός ορισμός του γάμου παραμένει αναλλοίωτος και αναγνωρίζεται το αποκλειστικό δικαίωμα των εκκλησιών να καθορίζουν, σύμφωνα με τις δικές τους καταβολές, τα του γάμου. Οι πιστοί των θρησκειών δε, μέσα στη δική τους θρησκευτική κοινότητα αποδέχονται σύμφωνα με τους δικούς τους όρους, αρχές και αξίες το ποιος παντρεύεται και πως. Εκτός των δικών τους κοινωνιών, τι τους ενοχλεί, αν τα πράγματα για κάποιους που δεν ανήκουν σε αυτές τις κοινότητες, φέρονται κατά διαφορετικό τρόπο; Θα μου πείτε ότι είναι το γενικό κοινωνικό καλό που έχει αξία και θα έχετε δίκιο. Πως καθορίζεται όμως αυτό το γενικό κοινωνικό καλό; Με την άρνηση των ίσων δικαιωμάτων προς όλους;
Η άποψη, πως η ένωση δύο ατόμων του ίδιου φύλου δεν χρειάζεται απαραίτητα να ονομάζεται γάμος, για να απολαμβάνουν αυτοί τα ίδια δικαιώματα δεν ισχύει. Κάτι που καθορίζει την ίδια διαδικασία (την ένωση δύο ατόμων) και έχει την ίδια νομική ισχύ, γιατί πρέπει να έχει διαφορετική ονομασία, αν δεν γίνεται μόνο για λόγους διάκρισης; Και την εποχή πριν της κατάργησης των φυλετικών διακρίσεων, κανείς δεν αμφισβητούσε το δικαίωμα των μαύρων να παίρνουν το λεωφορείο. Αρκεί να μη καθόντουσαν στις ίδιες θέσεις με τους λευκούς.
Το επιχείρημα πως ο γάμος είναι αποκλειστικά και μόνο για την διαιώνιση του είδους, δεν είναι απαραίτητα σωστό, εφόσον η νομική τουλάχιστον έννοια του γάμου δεν κάνει μνεία περί παιδιών. Πολλά ζευγάρια παραμένουν άκληρα κατ’ επιλογή, χωρίς αυτό να αμφισβητεί τη νομιμότητα του γάμου τους. Σε κάποιες άλλες κοινωνίες δε, η αναπαραγωγή αντιμετωπίζεται με την πολυγαμία, που για μας αποτελεί ποινικό αδίκημα
Ανησυχίες, όπως η αναγνώριση του γάμου, θα δώσει στους ομοφυλόφιλους το δικαίωμα της υιοθέτησης παιδιών, είναι μάλλον ξεπερασμένες, γιατί ήδη έχουν αυτό το δικαίωμα τώρα. Η έγκριση αίτησης υιοθεσίας από τις αρχές, βασίζεται στην εξονυχιστική έρευνα των αρμοδίων και στην καταλληλότητα των αιτούντων και όχι στο αν είναι παντρεμένοι και πως. (Μια διαδικασία, που εξασφαλίζει την αξία ατόμων να αναθρέψουν παιδιά, που δεν ισχύει, όμως, για τους βιολογικούς γονείς, με γνωστά αποτελέσματα.)
Όλες οι άλλες ανησυχίες περί ολίσθησης των ηθών και του ανοίγματος της πόρτας σε άλλες απαιτήσεις, που σήμερα θεωρούνται παράνομες και κολάσιμες, δεν ευσταθούν διότι, πρώτον, δεν γίνεται τώρα η αναγνώριση της ομοφυλοφιλίας- έχει γίνει εδώ και τριάντα περίπου χρόνια και η κοινωνία ακόμα υπάρχει- και δεύτερον, η αναγνώριση του ίσου δικαιώματος στα δεσμά του γάμου δεν υποβάλει κανένα άλλον σε παραβίαση των δικαιωμάτων του και της ακεραιότητας του. Η πολυγαμία, η ερωτική παρενόχληση, ο βιασμός, η παιδεραστία και άλλα αδικήματα εναντίον ατόμων, τιμωρούνται από το νόμο και διώκονται σύμφωνα με τον ποινικό κώδικα.
Οι αντιρρήσεις μας λοιπόν, στηρίζονται φανερά στις δικές μας προκαταλήψεις, θρησκευτικές αξίες, διακρίσεις και την πρόθεση μας να αποφεύγουμε την αναγνώριση ίσων δικαιωμάτων προς αυτούς που, ακόμα συνειδητά, δεν έχουμε αποδεκτεί σαν ίσους.
Προτιμότερο λοιπόν θα ήταν, να βασίζουμε ανοικτά την αντίθεση μας προς το νομοσχέδιο σε αυτά που πραγματικά πιστεύουμε και να μη προσπαθούμε να καλύψουμε τις αντιρρήσεις μας, κάτω από επιχειρήματα που δεν κάνουν τίποτα περισσότερο, από το να μηδενίζουν τη διανόηση όλων μας

Η ΟΜΟΦΥΛΟΦΟΒΙΚΗ ΠΟΛΩΝΙΚΗ ΚΥΒΕΡΝΗΣΗ

FUNDAMENTAL RIGHTS OF THE LESBIAN, GAY, BISEXUAL AND TRANSGENDER COMMUNITY UNDER ATTACK IN POLAND

SERIOUS CONCERNS AT INTENTIONS OF NEW POLISH GOVERNMENT

The outcome of the parliamentary and presidential elections in Poland in September and November has raised grave concerns in Poland's LGBT community. Leading politicians in the new governing party, Law and Justice, including the Prime Minister, have been prominent in attacking the LGBT community and banning public demonstrations.

The failure of coalition discussions with the more moderate right of centre party, Civic Platform, mean that the new government is increasingly closely associated with more extreme parties on the right, particularly the League of Polish Families. This party has been virulent in its opposition to LGBT rights, and its youth wing, All Polish Youth, has repeatedly organised violent and hate-fuelled counter-demonstrations against peaceful LGBT events.

Attached is a diary of events detailing attacks on the LGBT community in Poland by representatives of the Law and Justice and League of Polish Families in recent times.

These events raise serious concerns about the new Polish government’s willingness to fulfil its obligations under Article 6 EU, under the Charter of Fundamental Rights, and under UN and Council of Europe human rights conventions.

These concerns have been heightened by the reaction of the Polish police to an “illegal” march in Poznan last Saturday. In a marked escalation of response compared to previous “illegal” marches, the march was broken up by riot police and 65 demonstrators arrested.

Pro-equality organisations are responding by holding Equality Marches in seven cities this weekend.

We would particularly draw your attention to the following:

– On October 3 the Prime Minister, Mr Marcinkiewicz, is reported to have said: “the family is natural and the state must stand guard over the family. I do not care if someone is a homosexual or not … But if that person tries to infect others with their homosexuality, then the state must intervene in this violation of freedom”.

– The President of Poland, Mr Lech Kaczynski, has, on two occasions, when Mayor of Warsaw, banned peaceful demonstrations by LGBT people for their human rights. One justification he is reported to have given for these actions is that he is “against propagating gay orientation”.

– Mr Kaczynski has also expressed a surprising level of support for those organising violent counter-demonstrations and expressing profoundly anti-democratic views. Polish radio reported him saying that he was outraged by what he described as unequal police treatment of an LGBT parade and the counter-demonstration.

– In the spring of 2005 Law and Justice politician Kazimierz Michal Ujazdowski is reported as stating during an election meeting in Torun: “Let’s not mistake the brutal propaganda of homosexual attitudes for calls for tolerance. For them our rule will indeed mean a dark night”. Mr Ujazdowski is now the Minister of Culture.

– In November 2004 the chairperson of the City Council of Poznan, Law and Justice councillor Przemyslaw Alexndrowicz, reportedly said, in connection with the proposed LGBT demonstration: “I don’t want Poznan to see manifestations of different sexual orientations, that is homosexuality, paedophilia, necrophilia, or zoophilia”. The march was subsequently blocked when activists of the All Polish Youth began throwing stones at the marchers. Last week the Mayor of Poznan banned this year’s march.

– On occasion after occasion the youth wing of the League of Polish Families, All Polish Youth, has been clearly implicated in the organisation of violent opposition to peaceful demonstrations by the LGBT community.

– Finally, as one of its first actions, Mr Marcinkiewicz’s government has announced the abolition of the Office of the Plenipotentiary for Equal Status. The immediate abolition of such a key institution for combating discrimination underlines our concerns regarding the government’s attitudes to fundamental rights.

The overt and repeated attacks by public figures can only serve to incite hatred and violence against the LGBT community. In June Poland’s main LGBT organisations issued a joint statement expressing concern at the escalation of hatred towards homosexual people, and citing a number of incidents including the shooting of two activists outside a gay club (one of whom was a board member of Poland’s national LGBT organisation, Campaign against Homophobia).

SUGGESTED QUESTIONS FOR THE POLISH PRIME MINISTER:

In view of the suppression of the Poznan Equality March by riot police last Saturday, what steps will your government take to ensure that the 7 Equality Marches planned for this coming weekend take place, and that the police protect the marches rather than suppressing them?

You are reported to have said as recently as 3rd October: “if [a] person tries to infect others with their homosexuality, then the state must intervene in this violation of freedom”. Are you aware that homosexuality is not an illness, and that the use of such language is likely to incite hatred against homosexual people?

Do you recognise that the banning of peaceful demonstrations conflicts with Poland’s obligations as a member of the EU and as a signatory of UN and Council of Europe human rights conventions? What actions will your government take to ensure that such demonstrations are not banned in future?

Do you recognise that discrimination on the grounds of sexual orientation conflicts with Poland’s obligations as a member of the EU and as a signatory of UN and Council of Europe human rights conventions? What actions will your government take to ensure that lesbian, gay, bisexual and transgendered people can live their lives free from discrimination?

How will you prevent your government’s political dependence on the League of Polish Families from leading your own party to even more extreme homophobic actions and statements?

Do you accept that the League of Polish Families and particularly its youth wing, All Polish Youth, use extremist and violent tactics against the lesbian and gay community, and what action will your government take to prevent such tactics in future?

What were your reasons for the abolition of the Office of the Plenipotentiary for Equal Status, and how do you propose that its role in combating discrimination will be carried out in future?

A diary of events
2003 - 2005

March 2003: a poster campaign presenting same-sex couples to the Polish public in a non-controversial way is launched under the patronage of the Government Representative for the Equal Status of Women and Men. The mayors of Warsaw (Lech Kaczynski) and Krakow (Jacek Majchrowski) refuse to allow the display of the posters in their cities.

May 2nd 2003: Warsaw’s third Equality Parade passes off without incident. The 3000 participants were demanding legal recognition for same-sex couples.

April 2004: Krakow’s “Culture for Tolerance” festival comes under attack by the media and the city authorities. Many venues which had agreed to host festival events back out because of political pressure, mainly from the League of Polish Families, and its youth group, the All Polish Youth. Signatures are collected for a petition demanding cancellation of the festival, and anti-gay fliers are distributed in the city centre. All Polish Youth makes calls for “kicking homosexuals out of Krakow”. The League of Polish Families wins the overwhelming support of the regional parliament for a statement that “events promoting homosexuality [would be] harmful to the region of Krakow and the entire Lesser Poland region”.

May 2004: Krakow’s “Culture for Tolerance” festival goes ahead. However the march at the end of the festival runs into a blockade organised by All Polish Youth. It breaks up under a hail of eggs, stones and bottles. The youths pursue the marchers to the Old Town Square, where a riot ensues. Police shoot into the air and arrest 20 of the youths. Two of the marchers are hospitalised, one with a face burned by acid thrown in a bag.

June 2004: Warsaw Mayor Lech Kaczynski bans the Equality March, citing the possibility of violence, the timing of the march (one day after the Catholic holiday Corpus Christi) and route (the same as for the biggest Corpus Christi procession). An alternative march is organised by Senator Maria Szyszkowska and passes off without incident on June 13th.

November 2004: the Equality March in Poznan is blocked when activists of the Polish Youth begin throwing stones at the marchers. The chairperson of the City Council of Poznan, Law and Justice councillor Przemyslaw Alexndrowicz, had said: “I don’t want Poznan to see manifestations of different sexual orientations, that is homosexuality, paedophilia, necrophilia, or zoophilia”.
April 2005: the Krakow Culture for Tolerance march is called off, out of respect for the feelings of those grieving for Pope John Paul

Ο Alan Hollinghurst γεννήθηκε στο 1954 στην Αγγλία. Σπούδασε και στη συνέχεια δίδαξε στην Οξφόρδη πριν ασχοληθεί πλήρως με τη συγγραφή. Ο Alan Hollinghurst είναι ο νικητής του Man Booker Prize για το 2004 με το τέταρτο μυθιστόρημά του Τhe line of Beauty. Με το πρώτο του μυθιστόρημα The Swimming-Pool Library το 1988 επιλέχθηκε στη Λίστα Granta για τους Καλύτερους Νέους Βρετανούς Συγγραφείς. Ήταν σοφή επιλογή. Το 1994 ο Hollinghurst προτάθηκε για το Booker Prize και ήταν νικητής του James Tait Black Memorial Prize για το έργο του The Folding Star. Ακολούθησε το The Spell το 1998 και έξι χρόνια αργότερα το The Line of Beauty, το οποίο εκδόθηκε στην Ελλάδα από τις Εκδόσεις Καστανιώτη.

ΤΟ ΤΕΛΟΣ ΤΩΝ ΔΙΑΚΡΙΣΕΩΝ, ΤΟ ΤΕΛΟΣ ΤΟΥ ΦΟΒΟΥ

Men writing for a magazine like XY, marching with men to end sexual assault, hugging men in the middle of town. Must be gay, right? He shares domestic chores, doesn't compete at work and doesn't come on to the secretaries. Must be gay, right? The question, when it comes from men, is often meant to be derogatory, as if it's a threat or punishment. When it comes from women it's usually their assumption that someone who doesn't oppress women must be gay. They usually don't ask: they just wonder quietly.
The same goes for all the men who write for XY, those who read it and those whose pictures and cartoons appear in it. Look at the two men in the accompanying photo for example. Two men, arms around shoulders, familiar in each other's close company. They must be gay, right? Well, if they are, or one is, or neither are, it doesn't matter. The interesting thing is why you need to know just in order to appreciate the picture. What's the hidden meaning behind two guys touching? What is it we're so afraid of? Sticks and stones?
Some men will tell you these days that homophobia exists because "we don't want to catch AIDS". Sorry blokes, wrong answer. Heterosexuals have only been aware of AIDS for the past ten years and Western males' abhorrence of homosexuality has been in place for much longer. As an example, in World War Two the Nazis hunted homosexuals as furiously as they hunted Jews, while the antecedents of their hate of homosexuals are much older. Sticks and stones. Broken bones. Tools of oppression.
In our own culture we speculate that single men, the ones who haven't "had" a woman for six weeks, are "probably gay". Not having a girlfriend is a sure sign of being gay. Not playing footy is another sign. Being weaker than your peers is another. Not having a girlfriend, and especially still living with your mother when you're twenty five - more hard, factual evidence. In fact, being anything other than a 'real' man means you're about due, if not overdue, for a good solid whack of the oppression gay people fear and suffer daily. Sticks and stones. Tools of oppression affecting all men.
You might remember what it's like. Remember when you were in the school yard and the worst thing someone could do to you, apart from hitting you, would be to call you a girl, a sissy, a faggot or a pansy? When that happened you sure knew that you better stop doing whatever it was you were doing and start doing whatever it is they're doing, otherwise it's going to hurt a whole lot. It was the least worst option at the time, a matter of survival. So most of us learned either to conform and be one of the boys, or to disguise and deny whatever it was we really wanted to do.
If we made friends with a girl, if we made really close friends with a boy, if we helped the teacher, if we showed our true feelings, if mum kissed us when we got dropped off at the school gate, then we'd hear "Pansy!" Our peers yelled it, and even the girls (they also got taught what a 'real' man should be). Our teachers thought it. Our parents were troubled by it. Whichever way we went, we weren't allowed to cry, show feelings, be caring, nurturing or soft. Gays, and the ways society treats them, were held up as an example of what will happen to us if we don't conform. As boys, and now as men, we aren't allowed to keep our full humanity. Sticks and stones. Even the name-calling hurt each of us.
When we were small, being branded a poof had nothing at all to do with sexual preference. It's also the same now that we're older. Look again at the picture. You can't tell one thing about the men's sexual preferences. Only their genuine closeness is apparent. What are you so bloody afraid of?
The first punches of gay oppression land early and land on us all. These have nothing to do with who we may choose to love, our age or our goodness. All men are kept apart because currently our society says that if you want to get close to men then you must want sex from them: you must be gay. To overturn this belief requires acting on two things. Firstly, realise that being gay is an okay way to be, so being called 'gay' can never hurt you. Remember it as you move onto step two: keep getting close to lots of men: gay, straight, bisexual, nonsexual or rarely sexual. There are over 2.5 billion of us to choose from.
Just start off with one really close male-to-male relationship. A relationship does not equal sex, you will notice. You may even fear that you're gay when you try this. The fear you are feeling is the fear our society heaps on us from early on. Society needs scapegoats so that there's always a group of people below us in the pecking order. It makes us feel that the least worst option is to kick and hit them, so society doesn't dump on us. The fear is empty. Homophobia perpetuates it. Sticks and stones, taunting us from our pasts.
Unfortunately the old fear remains with most men, and it manifests as an irrational fear and hatred of homosexuality. They use it as a justification to discriminate against, maim and kill tens of thousands of men whom they suspect of being gay. Sticks and stones cost men's lives. Calling adult men names still hurts, just as it hurt when we were young. These crimes against gays in adulthood are still not about sexual preference. They are the cold winds blowing in from the bashings and tauntings of childhood. They blow not just for the poofter-bashers, name-callers and bigots as they seek victims, but for all men as we seek to get close to other men. That's why you're afraid. It's the only reason you could ever be afraid.
Hiding your humanity and connection with all men and women is not the least worst option anymore. Give it up. Reclaim fully your right to friendships with all people, especially those who are different from you.

And no, they didn't drink too much blueberry juice as young boys, or play with too many blue toys: "They are blue because--well--because they are blue. And I think they're remarkable wonders--don't you?"

Elly's upset when her grandfather refuses to invite Uncle Ned's "friend" Phil to his anniversary party. Her father explains that some people don't think it's right to be gay, "but I don't think it's wrong." This attempt to be helpful and informative just comes off as didactic--it doesn't say anything any parent couldn't just say to their child without a story.

ΚΟΥΒΑ: ΟΜΟΦΥΛΟΦΙΛΙΑ, ΧΛΕΥΗ ΚΑΙ ΣΙΩΠΗ

Cuba: Homosexualidad, burla y silencio

Una reciente versión de la novela El Conde de Montecristo para la televisión cubana fue extremadamente fiel al original de Alejandro Dumas, menos en un pequeño detalle: la hija de uno de los enemigos del Conde se escapa con su novio, en lugar de hacerlo con su mejor amiga. La televisión cubana tampoco ha exhibido el film Fresa y chocolate, que fue nominado al Oscar como mejor película extranjera.
(Mujereshoy) Al parecer, la intimidad entre una joven y su maestra de piano, muy bien delineadas en la obra de Dumas, no era una historia “adecuada” para el público infantil o adolescente cubano del espacio Aventuras. La maestra fue sustituida por un maestro y la relación original cambiada por un noviazgo heterosexual, con todos sus ingredientes.
Realizadores más arriesgados han hecho intentos de incluir el tema de la homosexualidad en algunas seriales televisivas, pero el producto final que ha recibido la teleaudiencia no se ha librado de los prejuicios y estereotipos existentes en Cuba hacia la diversidad sexual.
Así, un gay se pasó una telenovela hablando de su “problema”, sin nunca mencionar la palabra homosexualidad y dos lesbianas fueron “matadas” con premeditación y alevosía por el director de una serie. La muerte en un accidente de auto apareció como una especie de castigo divino a la mujer que había dejado a su esposo para irse con otra.
Paradójicamente, obras que han logrado abordar seriamente la problemática homosexual en la isla, como la película Fresa y chocolate (1993) de los directores Tomás Gutiérrez Alea y Juan Carlos Tabío, premiada en varios festivales fuera de Cuba, nunca han sido programadas en los espacios cinematográficos de la televisión cubana.
“¿A qué atribuye que una película como Fresa y chocolate nunca haya sido programada por la televisión?, preguntó SEM a especialistas e integrantes de la comunidad homosexual, a más de diez años del estreno de lo que se ha considerado una de las piezas emblemáticas del cine cubano.
Para la realizadora cubana Lizette Vila, no existen elementos contundentes que puedan explicar la decisión de no trasmitir por la televisión ese film. “Responder a esta pregunta me provoca sentir ‘la vergüenza ajena’”, comentó Vila, directora de dos documentales sobre la vida de los travestis en este país.
A su juicio, se ignora “el desarrollo cultural y el delirio cinematográfico que existe en Cuba y que ha permitido, con acierto, acrecentar la percepción de diferentes conflictos, puntos de vista y tendencias artísticas, asumirlos y formar juicios que finalmente constituyen un tejido social consciente, culto y enaltecido por sus valores éticos”.
“No tengo palabras”, fue la respuesta de la directora de revista cubana Mujeres, Isabel Moya. La comunicadora no pudo explicar qué puede haber frenado la exhibición de la película Fresa y chocolate, cuando la televisión cubana ha exhibido películas sobre el mismo tema, como la estadounidense Cowboy de Medianoche.
“Creo que es un reflejo de lo que sucede en la sociedad, de las manifestaciones homofóbicas de las personas que tienen el poder de programar, de decidir qué se pone y qué no se pone en la televisión”, dijo por su parte un homosexual consultado por SEM, que pidió el anonimato.
¿Humor o discriminación?
La inclusión en los programas humorísticos de un personaje gay, extremadamente amanerado, que provoca la risa por su propia naturaleza homosexual, ha sido la presencia más usual de la homosexualidad en la televisión cubana. Armando Álvarez, médico que trabaja en la prevención del Sida, afirmó que “la comunidad gay cubana no se reconoce en estos personajes”.
Esta es la “forma más fácil de no abordar el fenómeno”. Lo que se hace es “ridiculizar a las personas y al final se queda bien con la mayoría de la sociedad, e incluso con muchos homosexuales y bisexuales que no se reconocen a sí mismos públicamente. Prevalece así la imagen estereotipada de la homosexualidad y no hay peligros”, dijo a SEM.
Álvarez consideró que “el tema de la homosexualidad es poco tratado en los medios y, cuando se trata, además de satirizar personajes y reforzar estereotipos existentes en la población, se plantea como una conducta reprobable y marginal, casi siempre referida al sexo masculino.
“En el caso de las mujeres, el estigma y la discriminación es doble. Son discriminadas por el género y por la orientación sexual”, agregó.
Los prejuicios se extienden al tema del Sida. La mayoría de las personas infectadas en Cuba por el virus de inmunodeficiencia humana (VIH) son hombres homosexuales, sin embargo, la heterosexualidad prevalece en las historias de ficción televisivas, los materiales educativos y las campañas de prevención.
Una verdadera “aguja en el pajar” podría considerarse el espacio televisivo “Vale la pena”, conducido por el psicólogo Manuel Calviño desde hace más de diez años. Los análisis hechos por Calviño sobre diferentes conductas homofóbicas en Cuba quedan reducidos, sin embargo, a la escasa teleaudiencia de las altas horas de la noche.
A partir de su experiencia como realizadora de televisión y cine, y como defensora de los derechos de las minorías, Vila recuerda que “cuando no hay una respuesta justa, equilibrada o sensata, se tiende a replicar con burlas, tratando de ridiculizar el asunto que tienes que enfrentar”.
“El tema gay en Cuba ha sido abordado de una manera irregular, a veces utilizando códigos estereotipados y decadentes, y lo que considero más excluyente es que casi siempre ha faltado una mirada integradora, y más bien ha habido un discurso no comprometido con la verdadera esencia del mejoramiento humano, en que todos y todas somos parte de esa diversidad”, aseguró.
Para la cineasta, “este enfoque despojado de valentía, respeto y sensibilidad, está dibujado por una cultura despojada de los sentimientos de igualdad de género, de los conocimientos sobre identidad sexual y, sobre todo, marcada por la insolencia del ocaso patriarcal”.
Silencio impreso
Mientras la televisión empieza a abrir pequeños espacios sobre la homosexualidad, la prensa escrita mantiene el silencio sobre el tema y, cuando de manera aislada lo rompe, tropieza con la reacción de la cultura machista hegemónica. Esa fue la experiencia de la directora de la revista Mujeres.
“Publicamos un trabajo sobre homosexualidad, una entrevista a Mariela Castro, directora del Centro Nacional de Educación Sexual, y recibimos cartas de lectores quejándose. En una incluso me decían que cómo yo, tan seria, me dejaba coger para esas cosas”, comentó Moya.
Presidenta de la Cátedra de Género y Comunicación del Instituto Internacional de Periodismo José Martí, la periodista afirmó a SEM que resulta necesario empezar a “educar desde los medios en el respeto a la orientación sexual, pues todavía hay prejuicios en la población cubana sobre este tema”.
Moya considera que coexisten productos comunicativos de todo tipo, que llegan a ser “muy diferentes y a veces contradictorios”: los abordajes oscilan desde tratamientos muy serios, como el de Manuel Calviño en “Vale la pena”, hasta la homofobia de varios espacios humorísticos.
“Lo que se trata de hacer desde aproximaciones serias, contando con especialistas, se contradice con el abordaje de chanza y broma. A veces pienso que la masculinidad hegemónica se siente amenazada y recurre a la burla como respuesta”, opinó la directora de Mujeres.

Iran Reportedly Executes Two More Gay Men

(Tehran) Two men have been hanged in a public square in northern Iran after being found guilty of homosexuality a semi-official newspaper reported on Sunday.
The daily newspaper Kayhan said that the execution was carried out in the northern city of Gorgan. The paper reported the men had been found guilty under Islamic law of lavat, or homosexual sex.
The report identified the men, identified as Mokhtar N., 24, and Ali A., 25. The account claimed the men had “criminal past” that included kidnapping and rape.
Similar allegations have been made in the past when Iran executed gay men. Exiled Iranian groups say that the allegations are commonly used to justify hangings.
Homosexuality is a capital offense under Islamic law and gays have been under increasing pressure.
In August, another gay man was executed for homosexuality. (story)
On July 19 two gay teenagers were executed in the northeastern city of Mashhad. (story) The hangings sparked international outrage.
The Iranian government maintains the teens had raped a 13 year old boy - an allegation that many international rights groups discounted.
The exiled Iranian gay rights group, Homan, claims the Iranian government has executed at least 4,000 gays since 1979.
Several European countries halted extraditions of Iranian gays back to country following the executions. But, both the US and Britain have been silent on the issue.

Ο ΟΜΟΦΥΛΟΦΙΛΟΣ ΚΑΒΑΦΗΣ

«Η ομοφυλοφιλία του Καβάφη»

«O ερωτικός Καβάφης δεν έπαψε να αποτελεί αντικείμενο απώθησης, έλξης ή ταύτισης. Ενώ παλαιότερα το ενδιαφέρον εστιαζόταν στην ιδιωτική ζωή του ίδιου του ποιητή και εκφραζόταν μέσα από την αμφιλεγόμενη έννοια του ηδονισμού ή φορούσε τη μάσκα της ψυχανάλυσης, στις ημέρες μας ο καβαφικός ερωτισμός αφορά περισσότερο τους αναγνώστες ή τους μελετητές, εκ των οποίων ορισμένοι δεν διστάζουν να υπογραμμίσουν ότι προσεγγίζουν τον Καβάφη από ομοφυλοφιλική σκοπιά. Ετσι από τους μελετητές (Μαλάνος, Αλιθέρσης, Ουράνης) των δεκαετιών του 1920 και του 1930, που μιλούσαν για τον «ανώμαλο» ή νοσηρό ερωτισμό της καβαφικής ποίησης, περνούμε τα τελευταία χρόνια στον ερωτισμό της ταυτότητας, όπως φαίνεται και από την αγγλόφωνη πρόσληψη του ποιητή.
Το 1983 το αφιέρωμα στον Καβάφη του περιοδικού «Journal of the Hellenic Diaspora» είχε προκαλέσει, μεταξύ άλλων, αρκετές συζητήσεις για μια επισήμανση που περιείχε και ανήκε στους εκδότες του περιοδικού. Στον πρόλογό τους, στο αφιερωματικό τεύχος, δήλωναν ότι ο Καβάφης δεν ήταν ούτε «διεστραμμένος» ούτε «πρόστυχος» ούτε «ερωτικός», αλλά ομοφυλόφιλος και κατέληγαν λέγοντας ότι «αν ο Καβάφης δεν ήταν ομοφυλόφιλος, δεν θα ήταν Καβάφης».
Στα είκοσι χρόνια που μεσολάβησαν έκτοτε γράφηκαν αρκετές μελέτες, άρθρα ακόμη και διατριβές για τον ερωτικό Καβάφη καθώς και ένα άρθρο του Πίτερ Μπίεν (1990), στο οποίο υποστήριζε ότι η ομοφυλοφιλία του Καβάφη ήταν ένας σημαντικός παράγοντας για τη φήμη του στον αγγλόφωνο χώρο. Αλλωστε αρκετοί ομοφυλόφιλοι θαυμαστές του, όπως ο E. M. Φόστερ, ο Γ. X. Οντεν, ο φωτογράφος Duane Michals, ο ζωγράφος David Hockney δεν ήξεραν ελληνικά. Τονίζοντας ότι δεν υπάρχει ένας ξεχωριστός ομοφυλοφιλικός τρόπος για να μεταφραστεί η καβαφική ποίηση, ο Μπίεν καταλήγει ότι ο ομοφυλόφιλος έρωτας είναι άγονος και έτσι εξηγείται γιατί ο Καβάφης επιμένει στην πορεία και όχι στο αποτέλεσμα, στην απώλεια και όχι στη σταθερότητα.
Στη δεκαετία του 1990 κυκλοφόρησαν άρθρα για τον Καβάφη και από ξένους ειδικούς στη λογοτεχνία των ομοφυλοφίλων όπως ο Mark Lilly (1993), o Gregory Woods (1998), ενώ δεν έλειψαν και τα λήμματα σε εγκυκλοπαίδειες για την ομοφυλοφιλική λογοτεχνία (βλ. αυτό του Peter G. Christensen στο «The Gay & Lesbian Literary Heritage», 2002). Μπορεί τα άρθρα αυτά να μην είναι πάντοτε εύστοχα ή επαρκή, ωστόσο αναδεικνύουν τον Καβάφη ως μια κορυφαία μορφή της ομοφυλοφιλικής λογοτεχνίας και αυτό επιβεβαιώθηκε πρόσφατα και σε μια ημερίδα με θέμα «Νέες προοπτικές για τον Καβάφη», που διοργάνωσε στο University College του Λονδίνου ο Δημήτρης Παπανικολάου (Mellon Fellow του κολεγίου) και στην οποία συμμετείχαν πανεπιστημιακοί (Howard Caygill, Christopher Robinson, Gregory Woods, Γιώργος Συρίμης, Βασίλης Λαμπρόπουλος), ποιητές (Διονύσης Καψάλης), μεταφραστές (Dominique Grandmont) και καλλιτέχνες (Κων. Γιάνναρης, Κατερίνα Αθανασοπούλου).
Ενα από τα επιχειρήματα της ομοφυλοφιλικής προσέγγισης του Καβάφη είναι ότι τα ερωτικά ποιήματά του (αν και συχνά σε τέτοιες προσεγγίσεις ο διαχωρισμός των ποιημάτων σε κατηγορίες αμφισβητείται) απευθύνονταν σε ένα ομοφυλόφιλο κοινό και γι' αυτό δεν διακρίνονται για την πολεμικότητα ή την προκλητικότητά τους. Ως εκ τούτου είναι προσφορότερο ο Καβάφης να συγκρίνεται με σύγχρονους ομοφυλόφιλους ποιητές παρά με την παράδοση της ευρωπαϊκής παρακμιακής ποίησης από τον Ρεμπό και τον Βερλέν ως τον Οσκαρ Ουάιλντ. Για την ομοφυλοφιλική προσέγγιση του Καβάφη, η ποίησή του συνιστά περισσότερο έναν χώρο ταύτισης και διαπραγμάτευσης της ταυτότητας και ως προς αυτό συγκλίνει με τη διασπορική ή συγκρητική προσέγγισή του, που και αυτή έχει προβληθεί τα τελευταία χρόνια από μελετητές του Καβάφη εκτός Ελλάδος.
Και στις δύο προσεγγίσεις ο ρόλος του αναγνώστη δεν είναι απλώς δεκτικός, ή αποκρυπτογραφικός, αλλά βασίζεται στη βιωματική μέθεξη, καθώς η ποίηση του Καβάφη προβάλλει τη διαθεσιμότητά της ως πεδίο ταύτισης και αυτογνωσίας στον αναγνώστη. Και οι δύο προσεγγίσεις αμφισβητούν τις αυστηρές διπολικές αντιθέσεις και αναδεικνύουν τα διάκενα και την πορώδη υφή κάθε ταυτότητας. Σημείο σύγκλισής τους είναι η έννοια της μεταιχμιακότητας και η αίσθηση του συγκρητικού κράματος, ο μετεωρισμός και η αμφιθυμία μεταξύ φύλων, γλωσσών, εθνών και πολιτισμών.
Τελικά ο Καβάφης είναι ο ποιητής που προσδιορίζεται περισσότερο από κάθε άλλον από τα επίθετα που του αποδόθηκαν κατά καιρούς. Παλαιότερα ήταν ο ηδονικός, ο πολιτικός, ο διδακτικός, ο ειρωνικός Καβάφης, ενώ σήμερα πρωτοστατεί, κυρίως εκτός Ελλάδος, ο ομοφυλόφιλος (queer), ο διασπορικός και ο συγκρητικός Καβάφης. Πόσο χρήσιμοι είναι αυτοί οι προσδιορισμοί-ετικέτες δεν είναι του παρόντος να συζητήσουμε, αλλά ενώ από την Ελλάδα προβάλλεται με ειδωλοπλαστικό ζήλο και εθνική έπαρση ο οικουμενικός και διαχρονικός Καβάφης ως σταθερή αξία ή ως ο ποιητής που μιλάει εξακολουθητικά στους αναγνώστες και επηρεάζει ομοτέχνους του, από το εξωτερικό μας συστήνεται ένας Καβάφης πιο προσγειωμένος και επίκαιρος, που συνομιλεί με τις πολιτισμικές και ταυτοτικές ανησυχίες της εποχής μας, καθώς η ποίησή του παρουσιάζεται ως ρευστή, ανοιχτή και διαθέσιμη για να αναγνωρίσουν σε αυτήν οι αναγνώστες τους εαυτούς τους».
